so not happy with a vendor!- UPDATE!

Original post by Im_My_Own_Princess

I posted on here last week about how a vendor deposited a post -dated check two days early and I ended up being hit with $105.00 worth of fees...
yea well we're totally getting the run around from this vendor. he said he'd credit us and now he's saying that he'll contact the bank and try and get the fees waved.
bank of america will NOT credit a fee if they were not at fault.

I've lost sleep over this issue and honestly FH and I are not happy with the customer service.

We don't know what to do. Do we cancel the order and loose the $600 we've given to this vendor or do we continue with them and be un-happy?

**** UPDATE****
SO, I GOT AN EMAIL FROM THE OWNER, HE SAID HE FINALLY SPOKE WITH MY BANK AND THAT THEIR ERROR DID INDEED CAUSE SO MANY FEES TO MY ACCOUNT, SO HE SAID THAT FH OR I COULD STOP IN ANYTIME AND PICK UP A CHECK FOR $105... SO THIS IS A +, HE'S REALLY NICE, HIS WIFE NOT SO MUCH [B/]

i agree, marjorie, but you're technically not allowed to post date checks. the bank shouldn't have processed it anyway, but since you're not allowed to post date, they aren't going to refund money for something you can't do...

it is perfectly legal to post-date checks. its part of the tellers job to look at the date on a check.

The bank is absolutely at fault. It actually illegal to cash checks before the date and if they did they were wrong to do so.

firstly, i agree loosing $105 is something i would be pissed about. no its not $600 but every $1 counts.

next, you really should get in touch with the bank, the check was deposited at & be insistent with them. if your check is post-dated, shouldn't the teller have looked at the date???

i know in the past i accidentally tried to deposit a post-dated check & the teller at the bank told me it was post-dated.

it is 'illegal' to post date a check, knowing the funds are not available at the time of signature.
meaning.. you could write for $300.00 and put jan 3 on it.. but write it on jan 1 and only have $299.99 in your account- that is illegal.. but if you write a check for $50 on jan 1, put jan 3 on it and have $300 in your account.. that is legal.

its a stupid law that I NEVER HEARD OF before this.... out of everyone I spoke to.. ONE person knew it was illegal.. ONE!
I talked to a friend who works in a bank and she said she never knew that... but we looked it up and viola.. illegal!

so because of that bank of america will not credit me back the overdraft fees because THEY were not at fault. even if he went through chase, there is nothing chase can do about it... its either I give up and drop it or he writes me a check for $105.00 and make FH and I happy!

its my understanding that its legal to post-date a check as long as the date on the check is the day the funds will be available.
i know because i used to collect rent checks & tenants would give me a years worth of signed checks post-dated. i would hold them until the date on the check & then deposit them.
for instance, you write a $300 check dated for Jan 3, means on Jan 3 there will be $300 available.

that's ridiculous. the vendor needs to take the responsibility for it then.

and now they emailed me back...
I'm still getting the run around!

Hi (me), this is (co-owner) and I spoke to FH yesterday when he stop by the showroom. I would like to complete this matter, I need to have a document from your bank (with the bank's name and address)that indicates the charge incurred to your account due to the $300.00 deposit that you issued to my company. If you have any more questions please contact me directly either at my e-mail or at my office.

here's my issue:

the charge in question was the first charge on a new statement.. I tried to get a statement and I can't until this month closes.. so I have to wait until the end of the first week of december to bring this in.. THIS BLOWS!

Ok - relax.

#1 - you can get a screen shot of the charge if it's showing up in your online banking - Ctrl + Print Screen, the copy and past into a word doc & print.

if they need something official, just call your bank and have them email you an official screen shot.

#2 - it is illegal to post date a check - if your tenants gave you a stack of checks and told you to wait, then they trusted you with their money! This vendor obviously knew the situation and deposited it anyway.

If it were me, and this is JMO, I would see if I could get my $600 back and go elsewhere. From the tone of this guy's email it doesn't seem like he will bend over backwards for you and you don't want any more situations like this!

1- thats what I did... but it wasn't good enough
2- HE said we had a verbal agreement and feels horrible about the situation.. SHE is a little more cut throat.. I don't think SHE will give in and reimburse us.

I just read my contract.. it is 'uncancelable' ...so basically we're screwed... I'd rather go elsewhere or just forget the $600... hell I'd love to take them to smalls claims court.. but its not worth it.

I just don't want to deal with a company like them. one is rude and the other is helpful?

it's a lot of money, but your sanity is more important. do what will make you sleep better at night.

i just canceled a contract unrelated to my wedding and may not get my $500 deposit back. but once i canceled the contract, i was able to SLEEP and go on with my life. money is money, sanity trumps.

Um - OMG. It sounds like they are not the vendors for you. I would get the $100 back from them (possibly have the bank email them a screenshot or confirmation of the fee directly?) and then go somewhere else. $600 is a lot of money definitely, but these people do not sound like they will go above and beyond, which is what you want from your vendors.

it it were me, id keep the vendor and see how it goes

Re: so not happy with a vendor!

Honestly, I've been a bookeeper before and on the vendor end and it sounds like the vendor is doing whatever he possibly can for you. Like someone above said, all the checks get deposited at once and unfortuantely yours was in the pile. They were wrong for depositing it even though it was a mistake and the teller was wrong for processing it but that was an oversight.

Imo, and from what i've read, your vendor has done what he possibly can but it's not 100% his fault you were charged $105 in overdraft fees. If it were me i'd count my losses and move on. What's the other option? Lose $600?! It's not worth it imo.

The bank should be able to send you something stating the overdraft fees. If you have an online acct you can view it 2-3 business days after the check was cashed. You don't need to wait till the month's end.
