Speeding Ticket

Speeding Ticket

I am sooooooooo at my DH. He got a speeding ticket on teh LIE service road near Plainview. He said the P.O. told him he was going 70 in a 45mph. Anyways, it doesnt say how much. I looked the guide up online and it says court appearance required.
I know nothing about these kinds of things, but maybe you guys can tell me if you or someone you know, has had this happen as a first time offense; he never had a speeding tix before. What can be expected at court and how much could it possibly be!
Needless to say I gave him a HUMUNGO LECTURE b/c of his lead foot.
TIA

If he goes in with an attorney he has a good chance of talking it down to a lesser offense. FM me if you need the name of an attorney.

Re: Speeding Ticket

He may get points if its too many mph over the speed limit. He could ask for no points and just pay the fine.

My DH just went for a red light ticket that he got like 6 or 7 months ago, and the cop didn't remember what happened so it got dismissed.

If he reschedules the first court appearance, the next one will be like 2 months after that, and most likely the cop won't remember what happened

Good Luck

Re: Speeding Ticket

Well, he called his cousin who put him in touch with an attorney who told him its going to end up costing about $300 plus whatever fine they decide to give him. I DONT GET IT? IS HE BETTER OFF JUST GOING ALONE, ASKING FOR NO POINTS AND PAYING THE FINE OR GETTING REPRESENTED, PAYING THE ATTORNEY FEES AND THE FINE?
Geez, I just noticed I typed all CAPS.
Thanks for the advice guys.

Re: Speeding Ticket

if he was in fact speeding, why doesn't he just mail the ticket w/ the amount fined. IMO, i don't think it is that big of a deal. not to mention it affects his license and possibly his insurance. he is the one that should ultimately be mad, not you.

A few years ago, FH was pulled over on the Sunken Meadow by a state trooper -- he was also doing 25mph over the speed limit ..

You're not going to like this -

He went with an attorney (family member) - he was given 8 points (eek!) and a $250 fine.

The points are gone now, as they are taken off after 1.5 yrs of a clean driving record, and luckily his insurance co never caught up with the ticket (he paid it immediately- the next morning), so his insurance didn't go up. If the insurance co DID catch up w/ the ticket, he'd be looking at a huge increase.

Good luck to you and DH - anything's possible. You have a much better chance of getting out of a ticket w/ a Nassau cop than you do w/ a state trooper.

i should add that i received 2 tickets in the past couple of years and paid the fine right away. insurance NEVER increased. perhaps i was just lucky.

Hi. Thanks for your advice. The only thing is that they dont say how much it is. I wish it did so we can send it in right away. Thats what sucks about this.

it SHOULD be stated on the back of the ticket OR the officer SHOULD have provided a separate fine sheet. so sad that i actually know this.

if not, try and search OL or call the precinct.

I will look again. There is a schedule of payments and I also looked it up on nassaucountyny.gov, but its very difficult to understand. The closest I got was the type of offense and it says 'Court Appearance Necessary'

How can you tell on the tix if it was a Nassau cop vs State Trooper? All I know is that he has to go to Hempstead.

Re: Speeding Ticket

i always thought that state troopers patrol the 'state' parkways (i.e. northern, southern, wantagh, sunken meadow) and county cops patrol all other roads/expressways. i could, however, just be assuming.

it should say officer's name on the ticket and the pricinct.

exactly.

Also, there was no fine table on FH's ticket either - he went to the courthouse the very next morning and was told the fine and paid it.

Re: Speeding Ticket

i have fought a few tickets - the not showing up only works some place - never try it with islandia

if you go to court - what they usually do is half the points and set fine - it is the standard plea bargain

unless you have something reason for why the cop was wrong - wasn't a radar ticket, cop didn't have lights on at night - you aren't going to get the ticket to no points

for the most part it is not necessary to get a lawyer

Re: Speeding Ticket

NEVER NEVER just mail the ticket in and pay the fine.

ALWAYS go to the court on the scheduled date written on your ticket.

In my opinion, DO NOT get an attorney.

I have been ticketed twice for speeding .. about 10 years apart.

Both were in Nassau County .. Long Beach & Hempstead.

Both times they were reduced .. one was dropped down to 'following too close' .. the other was dropped down to 'failure to yield.'

I DID NOT have an attorney for either appearance.

Just go to the court and hear what offer the DA is willing to present to you. Let them do the talking .. say as little as possible .. with a clean record .. they tend to be more forgiving.

Both times I went .. they just looked over my paperwork .. spoke of my clean record .. and gave me the offer .. all I said in the conversation was 'okay.' I never discussed anything about the violation, and they never asked about it.

Also .. I wonder if it is a good thing to just pay the fine and take no points .. you may prefer to take a reduced charge .. to help protect your insurance.

My understanding .. speeding is about the worst offense when it comes to insurance rates .. so it may be better to take a couple of points with a reduced charge than accept speeding with no points.

And I believe if you were offered a lesser charge .. and took a couple of points .. the fine would be much cheaper than if you went strictly with a speeding fine .. those can get pretty hefty.

However .. you may not have a choice in the offers presented to you .. if one is presented at all.

But definitely go to court .. and skip the attorney .. they will not get you a better deal.

Just wanted to add:

In my traffic court experiences .. I have never seen a cop show up for any of the traffic violations being contested.

DO NOT just pay the fine .. it's like throwing money away .. because you absolutely should be able to get this reduced.

Re: Speeding Ticket

I got a speeding ticket on hempstead turnpike. It said right on it $85 and 6 points!

ALWAYS fight it.

My BIL is an attorney so he got to talk to the D.A before I went before the judge and the people who bring attorneys get to go first. There were a LOT of people there, so it made a big difference. What he was able to negotiate was an ''unspecified moving violation' and I only got 2 points. Which is really good. MUCH better than speeding!

I think it' good to have an attorney. They kind of know what to say and they get the professional courtesy of going first and ti was really really quick that way. I probably wouldn't pay $300 for it though.

A few things my BIL/attorney argued was that he asked how it was recorded and when they speed gun thing had been last calibrated. And he also said that it was near a big verizon building with antenna that may have thrown off the signal. Blah blah. I don't remember for sure, but I was really relieved to have the 'speeding' taken off and all those points removed

NEVER EVER pay the fine and mail it in. My DH has had to many speeding tickets to count he even had his license restricted. He has never just paid a ticket Always fought it. If this is the first offense it most likely will be knocked down to a lesser charge. He does pay an arm and a leg in insurance.

I only got one ticket (knock on wood) In florida. It was 92 in a 70 and I did just pay but only because I was not going back there to fight it

Good Luck

because he was over 15 miles over he cant mail it in........i dont think you need a lawyer for this one.........goto court talk to the da...and have him plead for a lower charge......it will cost to much for a lawyer and why if you can do the work yourself
