Tax on Service Charges Illegal?

I heard from my DJ that taxing a service charge/gratuitiy is illegal in Long Island. If that's true why are reception halls charging us tax on the service charge?

Has anyone try to voice this concern to reception halls? I heard that unless you say something to the recepiton halls nothing will change....
