So it seems the post disappeared that spoke about the pending deal with ScottoHas anyone heard from Ralph / his attorney regarding how this will impact those of us who canceled prior to the March 3rd deadline?

@ JennyandCraig2014...I did, I can't find it now, but I tend to look at all the jargon and sigh...I doubt we'll get any mail anytime soon that could mean we'd get our deposits back :(

The last thing we got was pretty clear that they were requesting additional time to finalize the plan of reorganization and the Disclosure Statement... this one is completely unclear.Agreed, it will probably be a while. They're lawyer told me a few months ago that we were looking at a May/June time frame for the re-org plan to be approved and distributions to be made, but I'm sure they will try and push it off as long as possible.

I haven't thought calling their lawyers would be informative really-have they told you much of anything? I'm curious if eventually, at any point, we'll get our 5k less the $750 since we cancelled within our contract date.

Just spoke to my lawyer buddy- he said in short they are telling them that they either need to act now and come up with a reorg plan, file chapter 7 and close completely, or be held in contempt of court. This is either going to be really good or really bad.

@masmith - We've called them a few times and they have been receptive and willing to give us information. Obviously take anything from those calls with a grain of salt since they are the venues lawyers.One way or another it seems like this step is the court forcing some sort of resolution to this. Hopefully it's in our favor.

Just an FYI - here's the court order filed after the hearing to show cause (you can sign up for a PACER account and view all of the court documents):'Upon the Court’s June 25, 2014 order to show cause to convert the within cases to cases under chapter 7 of the Bankruptcy Code (the “Order to Show Cause”); and at the June 30, 2014 hearing the Court on the Order to Show Cause the Court continued the hearing and directed that the Order to Show Cause may be heard at any future time that the Court deemed appropriate; and upon the emergency oral request of the attorney for the Debtors, the Order to Show Cause having come before the Honorable Robert E. Grossman on the 3rd day of July 2014; and after due notice to the parties and after hearing those parties whose appearances were noted on the transcript and it appearing that the appointment of a chapter 11 trustee is in the best interest of creditors of the estate, under 11 U.S.C. 1112(b)(1), it is hereby
ORDERED, that the United States Trustee shall, as soon as practicable, appoint a
Chapter 11 Trustee, with all the powers authorized under 11 U.S.C. §1104; and it is further
ORDERED, that the Management Agreement as approved by the Court by
ordered dated April 1, 2014 shall continue in full force and effect until further order of the Court'

Does this mean that they are being forced into chapter 7 or that there is now a court appointed trustee who will be managing the debts? I really don't see how this is going to end well for us.

So, I just hung up with their new lawyers. Their old lawyers told me that they had court appointed new counsel, and gave me their phone number. The lawyer I spoke to said they are liquidating and that the property will be sold, and the $ they get will be split among the people they owe money to. I said 'Jeez, good thing we cancelled, huh..' and she asked when our wedding is, when I said 9/26, she said we would've been one of the last weddings they had. She said by the end of 2014 it won't be Thatched Cottage anymore. I am heartbroken, and we aren't even having our wedding there anymore. Late 2014 and 2015 TC brides, good luck in finding another venue, we struggled with it so much.

I asked if Ralph has plans to just buy back his property and change the name and she said she didn't know. I bet anything Scotto buys it.

Thank you so much. I have a feeling that this is the end of any hope of getting money back. We are the low men on the totem pole. I'm not opposed to a class action lawsuit against Ralph personally if need be. This has been a dirty process and I'm ready to fight back!

I have a feeling a LOT of people feel this way...I'm still just so sad he let this happen to such an amazing place. Imagine the quality of all the weddings left to take place there? The employees know their jobs will be gone, they're most likely not fixing things that need to be fixed, who knows that happens to the food...I'm just baffled. The lawyer did tell me that of course all the $$ that Ralph owes to the state and Bethpage Federal Credit Union will be paid first..then we get scraps of what is left...I think I'll be surprised if we get a check for $200. :-/

Such an unbelievable shame. This really has put a huge strain on all of us. We were counting on at least half of our money back before our wedding and now, as it stands, we need to kiss it all goodbye. I feel horrible for all of the couples that stayed with him. He was dishonest and despicable not being upfront. We can only all now try to move forward from this. It has been helpful having you girls to talk to. Everyone hears 5k and thinks it is not that much but when planning a wedding 5000 is an enormous amount. It had put such a strain on us as a couple. Extra work, limited time, and emotional strain to say the least. A part of me is almost relieved that I can start getting past this.

Well, that sucks.You're probably right... Scotto will likely step in and buy the property for pennies on the dollar. We'll be lucky to get 10% of our deposits.... and then he'll just open it up under a new name the next day. Terrible.
