Trust Fund Question

Re: Trust Fund Question

If she set it up I'm sure she has authority over it. You should be able to read the documents pertaining to it, which is what I would do.

And OH (ETA) what a hideous person to do such a thing. I'm sorry you are marrying a MONSTER-in-law.

I would get a lawyer!

Re: Trust Fund Question

You must determine if the trust is irrevocable.
If the trust is 'revocable' she has the power to revoke the trust.

Next, find out who the trustee of the trust is who has a fiduciary responsibility to manage the trust in the best interest of the beneficiary.

Ultimately, see an attorney with a copy of trust.
(this is per DH who works with trusts).

Re: Trust Fund Question

If you want, talk to a lawyer - it probably depends on whose name the fund is in, etc. In the end, it's only money. Yes, it could make things a bit easier, but it's not worth compromising this big day. If she's not happy about it now, she won't be in 6 or 8 months. Hopefully your FH can talk to her and find out what is REALLY going on.

Good luck!

Re: Trust Fund Question

Okay, we found out more last night. His step-father's sister is the trustee. The trust is set up for 1 vehicle (which he already got), education (which he will not be going to college, until after the military), and house (building). In the trust, it says that if he gets married before he turns 25, the trust will dissolve and the money will revert back to his mother. So, he decided (without me saying anything. i just sat there and listened.) that he will let the trust dissolve and we're going to get married. My FH is such a sweetheart.

I'm just curious, but how old is your FH? If he's that close to being 25 then why don't you just postpone the wedding so that you don't lose the trust? I obviously don't know all of the details of your situation, but it just seems logical to wait so that you know that he can go to college when he's done with the military.

Re: Trust Fund Question

It sounds like you are giving up a lot financially to get married. This is one of the biggest reasons marriages end.

Will the military pay for college after he gets out? Is he planning for a career in the military?

I'm not trying to convince you not to get married-obviously you love each other and if you want to get married-you should. I'm just trying to be realistic about your future.

Also, maybe you could make a deal with his mom. Maybe wait until he's 20 to get married? Maybe she'll be a little more open to letting him have the money?

The trust was set up so that they money would be available for when he is old enough and mature enough to make sound financial decisions. I'm not saying he's not mature, it's just a cronological thing.

Just some things to think about.

The wedding is in 46 days, we've ordered everything. Apparently people don't understand that WE DON'T WANT TO WAIT!!!!!!! He is 18, so we are not waiting 7 years to get married.

His mother wouldn't be more open in 20 years. He is planning on making a career out of the military. And, he can go to school while he is in the service.

We are giving up some things to get married, but if you aren't willing to give up the little things, why are you together anyway??

I'm sorry if I sound rude, but I'm sick of people being so cynical and rude about their opinions of how young we are and how we should wait.

I don't think anyone is trying to be rude to you. When you post information about a personal situation on a public board, you are opening yourself up to different opinions. People are trying to be helpful to you and open your eyes to a different way of looking at your situation. I can only speak from my experience, but everyone I've encountered on this board has been more than helpful.

Good luck to you and FH.

I truly am sorry about sounding rude. I just have a lot going on and what she said sounded just like his mother, who is trying to get us to postpone the wedding.

I apologize if I came across in a wrong way.

Re: Trust Fund Question

Trusts can be set up with many different stipulations included.

What type of trust is this? That is a very important thing to find out. If it's a revocable trust as the mother as trustee, she can dissolve the trust anyway she wants to. If it's irrevocable, then no, the trust has stipulations that MUST BE MET. Trust are very specific as to how the interest and principal is to be used. This is spelled out in the trust. Does you FH have a copy of the trust?

No worries. I hope everything works out for you and FH. This should be a happy time in your life, not a stressful one.

I think her asking how old you were was more wondering if he was very close to 25 - like if he was 24 and 1/2, you may want to put off the wedding a 1/2 a year to get the $$$ (of course your wedding is so soon that I am guessing you wouldn't postpone it no matter what!). But since he is 18, waiting 8 years would just be insane - OMG that is so long!

Honestly, you can't win with this wedding business - everyone will always comment that you're too old/young or that your engagement is too long/short. It is a pain in the butt - I say ignore them all and do what is right for you!
