UPDATE -NEED ADVICE follow up to my accident - insurance agents
ok so i had that bad car accident. the car is not driveable and the accident was not my fault at all. here is where the problem starts.... my fh used to live in connecticut, has his policy, license in connectiuct (even though he already lives here) he has his business still in ct, and works in ct, i have a ny license, i sold my car in october and cancelled my ny policy, since we dont have two cars. nowwwww here is where it gets tricky ---- we took our civil wedding in aug (for other purposes) but we dont consider it really married since we're going to be married in our church in april. we dont wear wedding bands or dont introduce each other as H & W butttttttt legally we're married. so is a little messed up b/c we're married but he didnt add me to his policy. so when i called to put in the claim, they were so suspicous about the whole thing. and i dont know what to do now. FH will call his agent on monday.... is there anything we should/shouldnt do... i mean FH thinks the car is gone, even if they fix everything it wont be the same because the whole driver side is gone. so now i dont know what we should do.... because FH is thinking about a new car now --- just try to get some money (pay off the loan we have on the Audi) and get something new... any advice. how do we go about doing this? does the insurance agent need to send someone out first to see the car? plus the car is in massapeua. gee this is such a pain. we cant afford a car right with the wedding. TIA for any advice, help you ladies can offer
Gab
OK here is an update (1/15) This is what everything looks like --- our agent told us that if we want to get the car done they'd estimate it, we pay the deductible and the car gets done (WE DONT WANT THAT CAR bc we dont think it will ever be as safe and if we ever want to sell it, its going to be hard since its always going to be on the vin that there was an accident. So our agent said if we want to try to do that we have to go after that girls insurance company. So I called the other lady who was also in the accident (not guilty) and she said that they are going to fix her car, & I spoke with the guy from the auto body (who is also authorized auto body shop for my insurance) and he said that he thinks our car will be like 6k to fix. (our car is worth almost double that right now on kbb) so he said its up to you, we can either fix it or you can try to go after the girls insurance but if she had the lowest one (meaning i think 20/25k) then you wont get much. So now we're realllly bummed because the value of that car is going to be much less even if we fix it, we'll never be able to get the selling price. & we dont know what to do now... Any advice? Should we get a lawyer? HELPPPPP!!! As far as the car ---- both doors need to be replaced, wheel, alignment, suspension What do you ladies think?

Re: follow up to my accident - need some advice from insurance agents
From my FH:
Whether or not your are on the insurance, as long as the insurance policy owner (your FH) gives you permisable use of the vehicle, you should be covered. It doesnt matter if the accident is in NYS or CT or timbuktu you're covered.
What they will probably do if your FH continues his policy with said insurance agency they will simply add you to the policy andyour rate should not change unsless you are a bad driver
As far as how much you will get it depends on how the adjuster sees the damage. If they consider it a total loss they will cut you a check for the market value. If the market value turns out to be LESS than what you took out on the loans You and FH better hope that you have GAP insurance coverage. So they should be sending someone out to see the car most insurance companies operate in multiple states.
Hope this helps

Just remember, insurance is on the car, not the person.

Do you think they will rule the accident 100% not your fault? Because if they do, the other person's insurance will cover it.

Do you need to let them know then? (I don't know, just know that a similar thing happened to one of my friends and she didn't let her insurance company know...but she didn't need anything in the interim and just went out and got a new car and just left the insurance company out of it. But I don't know how that works if you actually need a rental for repairs and don't want to pay out of pocket.)
I would get FH to call instead of you.

exactly....you don't have to be on the policy to drive the car. The car just has to have insurance.

I don't think it matters much that your name is not on the policy however, although the other driver ran a red light they may still try to pin some accountability on your part. These insurance companies are ridiculous. Last year I was involved in a accident where the other party ran a 'Stop' sign. Fortunately, everyone was okay and there was an unmarked police car right behind me who was my witness and the insurance company find me accountable for 10% of the accident stating that although I had the right of way, the way our cars collided, I had enough time to see that he wasn't going to stop and to stop myself. CRAZY.
Good Luck, but definitely don't worry because your name is not on the policy. Whatever the outcome, thank goodness that you are OK.

You're FH needs to make the call to them since it's his car/policy.

i had the same thing... I am 'technically' insured under CT (where I grew up, and where its a buttload cheaper) and I got into an accident, as long as the car is insured, then you are ok... especially if it was not your fault... the other driver will pay for it all through her insurance. When I got into my accident the insurance company didnt even question why I was in NY, and I didnt have to pay anything!

The insurance should cover it regardless. But as far as the car being totalled that's up to the insurance company. They have to send a claims adjuster to look at the car, and if the damage is more then 75-80% (percentage depends on the insurance company) then they declare the car totalled. They then determine how much they will give you for the car, which doesn't necessarily mean you will get what you owe on it (if you have a loan on it). Once all of that is settled and your FH signs over the title to the insurance company they will send you a check for the amount the car with worth. Thats yours to do whatever you want with it.

Re: UPDATE -NEED ADVICE follow up to my accident - insurance agents
Getting a lawyer may not be the best idea since u werent injured or have medical bills. They are willing to pay for the damage. Which is al they have to do. Just because you do not want to keep the car is really your own personal decision. A lawyer really wont be able to do much for you. As long as the other insurance company is paying for the damage they are supposed too, you cant go after them. Also you have to remember lawyer fees are kind of expensive. Hope all works out for you.

Re: UPDATE -NEED ADVICE follow up to my accident - insurance agents
You can also go after her insurance for what's called a 'dimished value claim'. Ultimately it means they would pay additional money to you, based on how much you would lose trying to sell the car now that it has been in an accident. Some insurance companies make this really easy (ie you print them the kbb value for your car with and without damage and they pay you the difference) and others make it hard (you have to get a signed document from a dealer that says how much less the car is worth). You shouldn't need a lawyer for this, as I think it is something that a lot of insurance companies deal with, you just need to know to ask for it. I would call your insurance company and ask them how you go about filing a diminished value claim against her insurance.

Re: UPDATE -NEED ADVICE follow up to my accident - insurance agents
I hope everything works out for you - and second anything I say going forward I cannot say in entirely good faith until additional research is done...
What do you mean when you say 'if she has the lowest one' If by that you mean if her insurance will not cover, then if you have UIM coverage on your policy - your insurance should cover you for her lack on insurace. UIM = Underinsured Motorist coverage
Also - if I am not mistaken you are automatically covered under FH's policy since you are legally married. I have to confirm this and I am not even sure if this was your issue - I had a hard time following the storyline.
FM me if you have specific insurance questions - I work in commercial insurance which is different but I do have some knowledge. I have to consult my geeky underwriting books

Thanks What I meant by the lowest one, is the lowest coverage - you know how when you have a policy you can have 100,000$ coverage 250k 50k or whatever.... Thats what I meant Im no longer concerned with the marriage/being on his policy. Our biggest concern is how to try to get money out of the other insurance company. Jeez im so clueless when it comes to these things. You can tell I've never been in an accident
