What makes a basement an illegal apt?

What makes a basement an illegal apt?

Does anyone know what makes a basement considered an 'illegal apartment' in the town of babylon (lindenhurst specifically)?

Is it the addition of the stove, kitchen sink, or bathroom fixtures?

TIA!

I believe it is just the stove.

it's the kitchen.

I think it needs to have two means of egress too, where allowed.
But that would depend on whether the town even allows multiple family dwellings. The property owner would have to register it as two family or multiple dwelling and get a Cetificate of Occupancy stating that. Of course if all that is against local zoning laws, then it would still be illegal.

(to the best of my knowledge)

I think the law is that nobody is allowed to sleep under ground. For what reason, I don't know. Maybe fire code or something like that.

I think it is because there is only one entrance usually. and sometimes no windows or that a person could not fit through them. ALL basement apts are illegal

true, all basement apartments are illegal.

but what makes the basement an apartment? the stove, and the tenant

having a bath in the basement is not illegal, if you have the proper CO. You can even have a refrig, maybe even a kitchen (not sure on that one) - but you need the CO (certificate of occupancy)

but once you start RENTING it, its an illegal apt

(which are unbelievably common and not really enforced unless the town gets a complaint)

I live in Lindenhurst as well and from experience I can tell you it is the stove that makes it illegal but say you had a stove and had to unhook it for some reason you can legally have an one unhooked up stove on the premises. But you wouldn't want to store in the room where it could possibly be hooked up. Got what I am saying.
