Whats your take on this EBAY situation???

Person A lists a car on ebay. Person B bids and wins the car on ebay.

Terms of Sale:

$1000. deposit is due within 24 hrs of auction end. NO EXCEPTIONS! Deposit can be sent via Paypal or overnighted certified check. BALANCE MUST BE PAID IN FULL WITHIN 72 HOURS. Vehicle can be stored here for upto 30 days for free. You can inspect in person before auction ends. Buyer is responsible for shipping charges but I will assist with setting it up for a smooth transaction. DEADBEAT BIDDERS BEWARE Do not bid if you dont plan on buying. Bidding on this is considered a legal contract & you will be prosecuted. Happy Bidding & Good Luck

Person A emails Person B saying to call on their cell phone. Person B tries for 2 days to reach Person A to get an address to mail a Certified Check as stated in the ToS and winds up emailing them to get them to call them because Person A has been unreachable. Person A contacts Person B 2 days after the end of the auction. Person B then sends Deposit money via Paypal 2 hours later and both Persons agree that the balance will be paid in cash when the van is picked up. Person B then emails Person A about getting an interstate regi document and location of the pick up to which Person A responds:

The vin number for the van is listed on the Ebay ad. Unfortunately, I cannot send you a bill of sale until the van is paid for in full because that's like giving a receipt for something that
is not paid for. Actually, the van was supposed to be paid for in full within 72 hours of the auction ending as listed in the ad. Is there something else I can send you in order for you to get tags for transportation? Let me know. Sorry for the trouble.

Person B responds that they will not be able to get the interstate regi and not to worry about it and also asks if they would like them to PayPal the balance to Person A instead of what they agreed upon.

Person A within a matter of minutes returns the deposit $$ to Person B and says: Due to 2 breeches of contract the deal is off.

All of this happening between June 22 5PM and June 28 10PM

What would your take on the situation be???

If he returned your money... just walk away from the deal and find another van. Don't bother with this... he might have found another buyer (which is wrong in itself).

If he leaves you negative feedback... respond with negative.

and in the meantime take it up with ebay! and leave neg feedback regardless. I would def. send them a nasty letter telling them that THEY are in the wrong... and then walk away from this.... very shady on their part!!

If you send a negative over there way... they will most definitely reply with a negative for you. Only do this if you don't care about receiving a negative back.
