Where should Hussein's trial take place?

Original post by yabbobay

I personally think in the Hague...but I know that it will not...I don't think the US should have control over this trial and I have a bad feeling that if it is in Iraq that we will...

i just feel that the US's head is getting a bit swelled and we are completely forgetting about the rest of the world that is/was affected by this mess...

what are your thoughts?

Becky I agree with you that ideally it should be in Iraq...i just think that the US will have too much influence...

I voted Hague..

I think having the trial in the US will open a whole new can of worms.. We don't need that aggravation.. You think this country is unsafe especially since 9/11? imagine all the insane people that will be set off if it's here..

Exactly!!!

Are we even going to know where it is? Aren't war trials held in secret usually??

heres an interesting article why hussein should be tried in Iraq...seems that trying him in international courts could give him support...
as it did with Milosevic...who is running for Serbian president on 12/28

I voted Iraq. I don't think he should be brought here, he has cost us enough money already, no need to waste more on his sorry ass. And I heard today, if he is tried internationally, through the united nations, that he can not be put to death for his crimes. The united nations does not have the death penalty as an option. He should be tried in Iraq, where they will hopefully kill him eventually!!

I do not think he should be able to have a trial at all. He should be beat and torutred like he did to all those people, by thier families.

I know that sounds pretty harsh, but this a-hole did this before and the only way to stop him to is to kill him!!!

I feel that if the US handles this trial they will suffer more consequences... Those people over there are really psychotic... They blow themselves up for $hits and giggles! I feel an international trial will be most legitimate, but may prove to have injustice.

FROM NEWSDAY A PRISONER OF ONE OF SADAMMS PRISONS :::::

the 'Palace of the End,' where he lost 33 pounds, saw bloodied torture victims on stretchers, and was allowed to shower once - the day he left.

So when Hussein was captured this weekend, Herdoon thought it was ironic that the former Iraqi dictator was found in narrow hole, which he likened to the cell that he was squeezed into with two other men in a prison where many inmates never came out alive.

Herdoon, 67, said yesterday that the Iraqi president's arrest was a great victory and a great relief. Now, the office manager for an import/export fabric company in Manhattan wants to see him stand trial so 'that the whole world will know about his crimes,' he said. But 'I don't want him to die. I want him to spend his whole life in a prison, humiliated by the people that he tortured for 30 years.'

Other Iraqi exiles on Long Island want far worse: They want Hussein executed.

'I hope he won't be brought to the Hague [international] court because there's no death penalty,' said Maurice Shohet, a Great Neck resident who is also president of the Congregation Bene Naharayim, an Iraqi synagogue

When I initially voted, I voted to have the trial at the international courts. But the more I think about it, I think 'justice' would be served better if it takes place in Iraq!

The people who he tortured should get a right to speak and see him put to trial. And to see him executed like he so deserves.

The family of the people he killed deserve that right along with the people who suffered for 30 years under his tyrannical rule.

I can see Osama in the US...but our soldiers were killed b/c we invaded their country...thats not what this trial is about...

the trial will be about the horrific acts he committed against the Iraqis...

Hussein should be tried in Iraq by his own people, b/c his victim's families are the ones who deserve to have their stories told, and finally be granted some type of 'justice' for the crimes that were committed against their loved ones.

Re: Where should Hussein's trial take place?

I agree that, in principle, the trial should take place in Iraq. But it's important to think about whether the necessary judiciary institutions exist (they don't really right now), how long it will take to create them (a long long time), and whether people can wait that long (they probably can't). So, for pragmatic reasons, I'd vote my second choice, which is The Hague. One tricky issue for the US here is that we haven't (I believe) signed onto the ICC, so I don't know if this would complicate things.

Re: the jurisdiction of the ICC, it includes genocide and crimes against humanity and therefore, depending upon charges, Hussein could be brought up. Also, at least for the ICC, crimes have to have been committed after the enactment of the statute (2002), another potential limitation.

Another option is to do something like what's being done in Rwanda where the trials are being held in a neighboring country. But I really don't see an Arab country where this could work.

ETA: Just to be clear, Milosevic's trial, while at The Hague, is under the jurisdiction of an ad hoc tribunal. The ICC is the new, permanent body. The ICJ, which has been around for a long time and is also at The Hague, just deals with interstate disputes.
