Yesterdays post about Deli owner killing geese...

My friend is a lawyer and I emailed her the post and she wrote this....

i was wondering if the birds that were killed were actually ducks or rather canada geese? if they are canada geese--the ones that we have near the nursing home by the lake--then they are protected by NYSDEC. it is illegal to kill them without a permit. here is the link: http://www.dec.ny.gov/animals/34434.html. it explains it down at the bottom. i haven't looked into the duck issue, but i am assuming it was geese, not ducks because it is rare to have ducks behind the building and also not fly away when the car comes.

Hopefully we can get some charges placed on this guy!!!

Someone on the NW board did a Xpost. I don't remember who though...try doing a search. I saw it this morning, so it's probably only a page or two back.

I believe the original post was from Long Island Families (the OP said she lived near the owner of the deli I believe).

Apparantly he was going to be arrested and brought up on charges...

Here's the quote from LIF from the witness...

I just want to clarify, there is no doubt in my mind as I saw the whole thing. He completely aimed at the geese, as his original path changed to directly steer at them. No swerve, no turn, like a normal person would have done if it was an accident. He was going AT LEAST 45-50 mph at the point of impact.

An update: Fish and Wildlife came and I gave him a sworn statement with signature. It's a Class 'B' Misdemeanor therefore they have enough to charge him. They gathered the birds as evidence and will prosecute him to the fullest extent allowed by law.

I have no idea what happens after that, but my main concern isn't the charge because unless he has a record I'm sure it's just a fine and something on his record, but I'm glad they'll bring him away in cuffs. He's sick and twisted, and please understand, there is no doubt in my mind that it was completly intentional. I have no vested interest in making anyone's life miserable, or looking to start something for no reason, nor is this fabricated in any way. It is exactly how I described, unfortunately.

I have talked with him about many things over the 5 years I've worked next to him, and I've spent a lot of money there. There is speculation from other companies in our 'strip' that he's addicted to drugs, but again, pure speculation. I just want him to get what's coming to him, because it was horrific, and something I'll never forget.
