any lawyer brides---pre-nup Q

My friend is a lawyer and she is insisting on having a prenup (for her FH) and she is trying to convince the rest of us that we should also get one.
No I dont have any money :) neither does FH and we dont even believe in prenups!!!!!!!!!!but she is saying for money we accumulate individually or thru inheritence or some other BS..she is making it seem like we are doomed with out one...she has already convinced my cousin and her FH to have one...
Is this normally done even when ppl have no money??

Yes to protect your other assets, such as real estate.

ETA: I wouldn't say normally done but I know it is done to protect more than hard cash.

I don't know anyone who has had a prenup. DH and I, and many of our married friends are lawyers. None of us had any assets worth protecting before marriage. If, however, you own real estate, stocks, bonds, etc., you may want to protect those assets with a prenup. It's a personal choice and definitely something to consider. However, don't feel pressured into signing one.

I agree with this. lovetolove, is your FH still in school (residency), or practicing? If he is still in school, you will be entitled to enhanced earnings when he starts making a regular salary. I am finishing my doctorate and my mother actually tried to convince me to get a prenup so that my DH would not be entitled to enhanced earnings because I am paying my tuition out of my own money, not our joint funds. We didn't get a prenup, but if he makes more than you, it's probably in your benefit not to have one. We bought our real estate jointly. If I had owned something by myself before, I might have considered it.

Just my input... I personally feel if you need a prenup, i understand the purpose or protection, but if you need one do you really want to marry this person? It's almost like planning a divorce before your even married?!?!

I guess I am just a victim of my own nieveness, FH has more than I do and if we were to ever have troubles, I would rather put my efforts into trying to save our marriage not into a bitter divorce...I don't want his stuff I would just want to move on! I guess I just feel if you are marrying someone you have to take that leap of faith and trust things will work out.. in the end i am not a big believer in prenup, if asked to, i would do it caue it doesnt matter to me although i would feel slightly distrusted...

As a woman I completely agree with you. If you need a pre-nup why get married in the first place. As an attorney, I disagree with the second part. I have seen all to often that if a marriage ends badly the feelings that are left are the need for revenge and taking him/her for everything they have. Usually by the time it gets to divorce the efforts to save the marriage (counseling etc) have already been made, and all that is left is bitterness.

I wouldn't get one. FYI, inheritance is not up for grabs during a divorce. Whoever inherits the money keeps it.

Inheritance is separate property. People who have no money but are in school for a good degree (MBA, MD, JD, etc.) get prenups to protect their degree (which is marital property if earned during the marriage).

My husband is a divorce lawyer at the largest matrimonial firm in the country. They have represented a million celebs (Howard Stern, Donald Trump, Steven Tyler, Woody Allen, Al Pacino, etc.). If anyone needs a prenup, let me know.

yeah i have to say that i would never, ever get one. whatever money i have or my FH has is ours and i trust him with anything and everything.
all of our accounts are joint, we invest together, and any real estate, cars, etc we own are in both of our names.
i also trust the sanctity of our marriage and i know that divorce is not in the cards for us. i know some people might think that saying we are not going to get divorced would 'jinx' us but if their were any doubts in either of our minds we would not be getting married in the first place.
he is my one and only and i what's mine is his. corny but ture lol haha

I don't think anyone really wants to sign a prenup b/c they don't want to consider the possibility of the marriage ending. However, considering how high the divorce rate is, it's probably best to protect yourself especially if you acquired a lot of assets prior to the marriage. I wouldn't look down on anyone who had a prenup. I think it's practical, especially under certain circumstances. We can't predict the future and how our relationships will change over the years. No one wants to prepare for divorce, but unfortunately this is a reality that people may face. I'm sure there are plenty of people who regret not having/signing a prenup.

I agree with this. Personally, I'd rather make decisions about certain property now while I love DH and we have a wonderful friendship than down the road if we ever (heaven forbid) get divorced and our judgment is clouded by bitterness and anger.

I've been on this site for several years now and I need two hands to count the number of divorces I know of personally of ladies I met on here, and I am sure there are others that don't go public. These divorced women were on BHB recently, thinking divorce would never happen to them. We can all say we will do whatever we can to save our marriage, but no one can predict the things that can happen.

With all do respect here - no one ever gets married planning on getting divorced but the reality is you never know what is going to happen. I adore my FI and we have a wonderful secure relationship but I see nothing wrong with signing a prenup. In addition, I dont understand why a FH or FW would care signing one if they dont see a divorce in the future anyway. As a product of divorced parents, I feel strongly in protecting yourself and making informative responsible decisions just in case. No one has the intention of entering a marriage that ends in divorce but in reality marriages fail all the time.

I never belived in them- until my Mom died and my Dad started dating a GOLD DIGGER

My Mom worked hard and saved and invested her money - and if my Dad remarries this women- he has promised to get a pre-nup- b/c my Mom would roll over if this women got her hands on what is rightly my bothers and sisters

but in case of a first marriage- I still don't believe in them

Your friend is mistaken about inheritance. If you inherit $50 million and then try to divorce your husband (and you have a prenup entitling him to say 30% of marital assets) the $50 million is not included

As for degrees, if they are earned during the marriage (not even that you have to help pay for the degree) then the income resulting from the degree is marital property. Say he is a med student and by the time you divorce he is a top surgeon earning $1 million a year. That $1 million salary is marital property.

This is not necessarily true. If you inherit money during the marriage and deposit that money into a joint account, it may be considered joint property (to be divided among you and your spouse). If you keep the inheritance separate, then the law considers it separate property.

I don't know. I've always heard that any inheritance money was not up for grabs.

Nothing about matrimonial law is black and white--it's very complicated.

This is true. Once it becomes joint, its just that...joint.
I am sooo surprised by what I am reading, most of these responses have brought tears to my eyes. I understand lots of you are not married yet and are still blinded by bliss ..but for the lawyers here..what a surprise!
I agree that a prenup is not needed in every case but to be so naive as to think 'it can never happen to me' well, live & learn.
Let me tell you about my ex-husband..we were also very much in love,we had a son together and then.. things went sour. Lets just say he became another person totally! Not only was I surprised but my whole family was in disbelief. My family was very generous to us,especially when their first grandchild was born. We have a family run business and things were very lucrative..I ( & only I) worked very hard with my parents...they rewarded me with giving me $$ to buy a house. The house was only in my name, but that didn't protect me( acquired during duration of marriage) thank GOD I signed a waiver by the urging of my lawyer that I owed my parents Xamount of $$$,just as a precaution. My parents would never ask me to pay-up so I new I was only signing it to give my parents piece of mind. My ex never knew of it since it was between my parents & myself. It was notorized & I never thought much of it. Anyway.. like I said, things went bad. When I was married I was naive & never in my wildest dreams thought I'd be a statistic..also I was just finishing school & also could have no way of knowing 'properties' I would one day have. By the time we were in mediation he wanted EVERYTHING. Wanted me to sell the house my parents bought ( they rather gave me the $$ while they were alive than rather as an inheritance later) actually told me that 'OUR' son & myself can go live in a basement for all he cared...did I mention that he was having an affair? You girls would be surprised by the power of pu$$*. He ended up cleaning out bank accounts (because they were joint) maxing out CC ( I ended up paying off because it ruined my credit) took a car I bought because 'it was aquired during the marriage'..it was beyond bitter. He didn't get the house because that little piece of paper that I was actually mad at my parents & lawyer for even suggesting..saved me!

Now,sorry it got sooooo personal but many of you need a wake-up call. God forbid this was to be YOUR situation but.. they say 1 in 2 right? If its not you,it'll be someone you know. Pre-nups are not evil, they do not 'doom' a marriage... why don't you think of it as 'we have this agreement but we are confident that we will NEVER need it' & then put it away. If you don't care about yourself..then think of it as protecting your future children.
Last year I got remarried,I absolutely adore my husband & he truely is my soulmate. But,we have a pre-nup. At 32 & 36 we each have assets to protect,God forbid something happens to me,I have a child to protect.
Like I said,I trust & love my husband and feel I will never have to enforce this paper..but..never say never. My ex wanted a piece of the action,a house and business he never invested a dime in..things my parents worked hard for. I'm not morbid & negative thinking this will be your reality, just not naive.

Good Luck & God Bless you all.
Sorry if I got too personal..but I don't want any of you to suffer.
