Any lawyers here....UPDATES WITH REASON

Thanks to those that FM'd me and just to let the rest of you know, it wasnt a Big Huge legal problem....just a question....I dont need a lawyer, we're not being sued, nothing like that.

My question was just how can a cell phone company charge an early termination fee when they have nothing on their end that show that the contract was terminated early. They have nothing to show me and expect me to pay them?

I am, but not in NY. Might still be able to help, though....

I'm a lawyer in NY, but I cannot help you with any substantive law questions / personal legal problems. If it's somehow something other than that or if you need a recommendation, let me know.

Same here; you are not going to find lawyers on this message board that are going to give you legal advise. If you FM me your issue I may be able to refer you to someone who can help you.

Maybe you can just post your question and who knows somebody who is not a lawyer might be able to help you. They might have had the same problem and can give you advice on how they handled it. Some people just know the answer for whatever reason

i THINK if someone NEEDS help and needs advice, they should be given it. Lawyers just want $ for advice. I worked for a lawyer once - NEVER again . . .

FM me if u need advice. Im not a lawyer but did work in a lawfirm.

Re: Any Lawyers here?

I personally don't know too many people who work for free. If they gave out free advice they would get phone calls 24/7.

MrsBrags7706 Posted:

No well there are such things as free consultations.

Espo22 Posted:

Re: Any Lawyers here?

yeah with the chance of the lawyer being hired. They will give you a free consultation and then tell you how they can personally help you. Also, depending on the situation i am sure alot of girls on here who are lawyers can't give advice because it is not the area of law they practice and not their expertise, so they can't help out with that.

This is a completely ridiculous statement. As a lawyer, I can say that my not giving advice on this board has nothing to do with money. I personally am bound by my job and by the rules of ethics to refrain from giving legal advice on the side for many reasons 1) because my fim carries my insurance and 2) I am an agent of their firm who is unauthorized to choose their clients (both paying and non-paying clients). The rules state that this includes an initial consultation since that technically makes one a client. If I give the advice, then legally the firm is giving the advice, and they can't be responsible for every post someone puts on a message board. This may be selfish, but I don't feel like being fired and disbarred over it. I give plenty of advice for free through authorized pro bono projects and I would like you to try for one week to work at a large law firm, as a lawyer, carry our hours, and try to plan a wedding on the side before you throw cheap shots at us.

Several girls were more than willing to refer the original poster who needed help to someone who could help them, likely someone who works as an independent attorney or has the authority to choose clients for their firm (and you know nothing about their payment arrangements). I'm sorry if you had a bad experience with a lawyer, but it is pretty unfair to condemn all people who practice a profession when clearly you are not fully informed of the reasoning behind one's decision. Are there not teachers who abuse children or fail to teach them, doctors who botch surgeries, businessmen who bankrupt or steal money from their businesses? Are all of these professions awful to you as well?

I take umbrage at your comment. You are clearly misguided and misinformed. I'm sorry you had a bad experience working for a lawyer, but that doesn't mean all lawyers are money-hungry scum bags.

The problem has absolutely NOTHING to do with wanting to be paid money to give advice. My firm pays me more than enough to doll out all the advice I want. The problem is that we are contractually and ETHICALLY obligated NOT to give out advice like this on the internet or anywhere else to anyone who is not a client -- and for good reasons:

1. Conflicts of interest - If I'm out giving every tom, joe, and harry off the street legal advice, then I am going to know a lot about them and they are going to know about me. Every firm and every solo practice lawyer has to run conflicts checks before taking on any new conflicts. Conflicts of one lawyer are imputed to the entire firm... so my conflict would be imputed my entire firm (2,000+ attorneys). Of course, since no one knows I gave this legal advice, it wouldn't show up in our conflicts search... If it every came out, I'd be in big trouble, as would my entire firm. This is mandated by the NY State Bar Association and our ethical rules. Violation of these rules (which are long and complicated) can result in reprimand, suspension, or revokation of our licenses to practice law.

2. It also violates the terms of our employment and puts our jobs in jeopardy. I'm sorry, but I'm not about to lose my job or my license because people want free advice on the internet. It's got NOTHING to do with money. I can't even give my own family legal advice.

3. One of the reasons lawyer are so expensive is because of the massive amounts of malpractice insurance we have to carry. I'm not going to risk getting sued by just anyone asking a question on the internet.

4. Lack of information - If you're not my client and you want a 'quick answer' over the internet, then I'm not going to get all the facts I may need to give appropriate advice. This could lead to me getting sued or the person asking for advice getting in trouble.

5. Lawyers don't know all the laws off the top of our heads. We have to look up the law, generally in a legal search database online that is extremely expensive. To top that off, it requires a billing code. This means to do any reserach to give someone an answer, I'd have to charge it to an existing client. That's a gross voilation of the ethical rules and grounds for reprimand, suspension, or revocation of my license.

6. There is absolutely NO protection for the person wanting the legal advice. We wouldn't have a fiduciary relationship or any sort of contractual agreement. In the event we give her misinformation or bad advice, she has very little stand on to hold us accountable for that. If she tries (which most people would), then it could become an even longer, more expensive suit for both parties... Oh, and firm malpractice insurance isn't going to cover the cost of unauthorized advice given to a non-client.

Bottom line, we're ethically and contractually obligated NOT to give out legal advice like this, and it's NOT a smart thing for the lawyer or for the person asking for advice. Don't assume it's all about money. It has absolutely nothing to do with that at all.

To the OP, if you have a real legal problem, don't get advice from anyone on the internet who says they're a lawyer or worked for a lawyer... If you have a legitimate legal problem, go talk to a lawyer who specializes in what you need.

I work in a law firm as well. And it is even illegal for paralegals to give any type of legal advice. If you need help, seek the help of a real, live, practicing attorney.

Ahh! you quoted me before I could edit my typo! I meant 'they're' not 'their.'

Clearly it's too early to be defending my profession!

Yes, I agree with the other girls. It has NOTHING to do with money. It has to do with the Code of Ethics that lawyers need to follow.

I would also be hesitant to take legal advise from someone who is not a lawyer. As noted, most lawyers will give free consulations.

That's okay - Most people don't understand why lawyers can't just offer up legal advice. This thread offered a good opportunity for people to learn something they might not otherwise have known. Don't feel bad!
