I am glad to hear that your husband is okay. Make sure that you notify your insurance company asap just in case the other driver tries to say that your DH was at fault. You should always at least notify your company even if you intend to go through the other's person's company to have the damage repaired.

You have two choices in a situation such as this.

1. You can go through your own company and let them collect back from the other persons company. If you do this you will have to pay your deductible upfront and when (and if) your insurance company collects it back from the other carrier they will reimburse you.

2. You can go through the other person's company. If they agree that their policyholder was 100% at fault they will pay you what they feel is a fair amount to repair your vehicle. They will send out an adjuster to estimate the damages and then make you an offer. If you decide to go this route make sure that you get an estimate yourself also from an auto body shop. This way if you feel the estimate that the insurance company is giving you is too low you have something to fight with. In this situation you would not have to pay any deductible.

I would suggest going with choice number 2, but only if the other person has already admitted they were at fault and you have a police report indicating the way the accident occured and it clealy states the other driver was at fault. If there is any question or the other person is fighting it and saying you were at fault then you should go through your own company.

I had an accident 4 weeks ago and had to pay the deductable, but I did get it back.

The insurance company said that it was waived cause the accident wasn't my fault.

DH was driving through an intersection (he had right of way) and some schmuck in a sports car was coming from the opposite direction and thought he could cut DH off and make it, trying to make a left - well, he didn't! DH slammed on his brakes but hit the back section of his car.

Our police report doesn't yet specify the actual events (just the facts), that will be ready later this week, but even the cops said it was a clear-cut case that DH had the right of way. the schmuck tried to say that DH was speeding, but even the cops didn't believe him. And lord knows my hubby doesn't speed - I'm the crazy driver of the family!!

I contacted my insurance co. today and the adjuster has already called - now I need to find an auto body place nearby! They did tell me we'd have to lay out the deductible but we'll fight to get it back from the other insurance company. Hopefully we won't have a huge problem with who did what, etc.

Before I read it, I sent up a word of prayer, I am happy your hubby is ok. A car can be replaced but I life cannot. I hope it all gets sorted out and it is not too costly.
