Luckily he's ok and it wasn't his fault. Our car's really damaged though
I have a large deductible for collision insurance - even though it's not our fault, do WE need to pay the deductible, or does the other driver's insurance pay for it?
Never been in an accident before!

You may want to check with your insurance company. I was in a car accident last year but I was a passenger in a private cab company so I dont know anything about the insurance and deductable stuff.

Teri - sorry to hear about the accident, but glad your DH is okay!
As far as insurance, I believe you have to pay up to the deductible, and the other motorists insurance should cover the rest. But that's not always the case, so it's best to call the insurance company and find out.

I just asked DH (he's in auto insurance) and he said most likely you will have to pay the deductable.

thanks everyone - luckily he was fine - just shaken up. He was out getting me ice cream - what a sweetie I was so scared when he called and told me!
I'm going to call our insurance co. first thing in the AM, but I really hope we're not responsible for the deductible - it's $500!! We probably are though - such BS

Teri - don't feel bad - I raised my dedictible to $1000 so it would lower the overall cost. Now it's making me wonderif I should have!

If it is completely the other guys fault and the police report shows this-- you don't have to go through your insurance so you don't have to pay anything!! This is what just happened to us in may/june. The guy was 100% at fault we didn't have to bother with our insurance and didn't pay a dime!

i believe you have to pay your deductable.. but once the goes through you will get your deductable back... but if they are completley at fault you should be able to go through their company without having to deal with yours(which is what my fiance is doing right now)..

I'm so glad James is ok! I don't know for sure about NYS laws, but I think if its the other person's fault their insurance is responsible for your deductible/expenses.
