EMPLOYMENT ? NEED HELP

OK I started a new job and sit alone (love it), now they want to give me more stuff and move me to a different spot. I feel sick to my stomach. Why? Because I can not stand this one woman, who is loud, obnoxious and curses all day long. Do I have to be subjected to her vulgarities all day long?

ETA: I told them I do not want to sit near her cause of the above.
What rights do i have?

NO!!!

You absolutely do not have to tolerate vulgar behavior from a co-worker or supervisor. You can report her to HR and tell them that her cursing creates an uncomfortable work condition for you.

Can't you claim a hostile work environment? There is so much that is not allowed I doubt that your workplace can allow cursing.

I still think you can claim a hostile work environment regardless of the size of your company.

You have a simple request - I can't see why your company won't honor it. Can you still do more work sitting where you sit now?

This woman should be made aware of the fact that her behavior is making you uncomfortable (by you or by a manager/owner, etc) or risk disciplinary action up to and including termination. (that's how our handbook goes).

I told them this. To be honest and open, I did not attend my xmas party here this year because I could not imagine being near her outside work!!! They postponed the party for me (my surgery) but it worked out my boss couldnt do the day of my surgery anyway so i dont feel bad that i didnt go.

Is your company owned by a larger company? There should be SOME kind of HR, even if it's not in your office (for example, my DH's company is owned by a parent company, whose HR offices are in Boston). If so, you may need to escalate your issue to them in order for any 'official' action to be taken. Otherwise you may be stuck with her

They are leaving themselves open for a lawsuit. What do they say when you tell them that you refuse to work with someone like this? Do other people in your office feel this way about her?

We had someone like that here (not annoying, but borderline dangerour) and it took an actual act of violence to get her fired because the owners of my company are so pathetic.

ETA - look up harrassment laws for NYS to get a clearer definition of what your rights are and what your company's responsibility is.

if your company is so small, chances are I hate to say it you might have to move and just grin and bear it b/c you have not been there that long they might have no problem with her what so ever, I would move if you must but tell her nicely you would appreciate if she was n ot so vulgar and loud around you b/c it affects your nerves!

Everyone feels this way about her, why they tolerate her I have no idea.
I need to look into employment law on this.

No this co is owned by 2 men, they are both here.

ITA that you should look up employment law and that the company could be opening themselves up for a lawsuit. You should not have to put up with a hostile work environment.

Can't you ask them if you can still take on the extra responsibilites, but sit alone? What is the advantage to them of moving your seat?
