UPDATE:

The arbitrators ruled in my favor! Got a judgment in the mail today against Gina -- she has to pay me in full, plus pay interest and filing fees! She has 30 days to pay. The courts moved pretty quickly on this one!

It's my understanding that if Gina doesn't pay within 30 days, MarBear can employ an Enforcement Officer to seize her assets. That person can go after her bank accounts or real estate.

Luckycouple05, mine was 9/5, if that helps.

My court date is 11/23 in Brooklyn, if anyone can make it. :)

Depending on the county, she can go to either the County Sheriff or Marshal's office to get an execution. At least that's what we do at my office if we get a judgment in our favor and they don't pay....

I am delighted you got it resolved. I just hope she pays up now.

I want to reach to everyone and apologize to all the brides that were affected by the Gina situation. I am so sorry that I backed her up and insulted you on the forum. I had the opportunity to talk to Gina face to face and I believed everything she told me. I am a very naive individual and I felt like it was up to me to say something in her behalf just because she's a single mother and I didn't want to see her business go down. After I said everything I felt really guilty because I started hearing all the stories that the brides had and I couldn't believe she lied to me about everything.
Gina said that she was reaching out to all the brides who's wedding she missed and that she's arranging a payment plan with all of them.
She also said that her hospital stay was from the 17-18 of August until labor day so it still doesn't excuse anything. I know she was in the hospital I found out from the hospital that she was picked up the day after my wedding which was August 15th. All her stories were mixed I couldn't tell what is true what isn't. She just looked so helpless and I wanted to help her. I know really stupid of me.
Any of this doesn't matter anymore she's full of **** and I want to do everything possible to see her go down and pay every single one of the brides back !!!!
I can understand if you guys don't want to help me after everything but if anyone does please contact me on FM and maybe we can go to small claims together.

Again I am sorry to everyone and I really need your help.

just so all of you know - arbitration isn't binding unless gina agreed to it in her contract. and seeing as (i) she probably didn't have an arbitration clause in her contract and (ii) didn't even show up to the arbitration, the arbitrators' decision means absolutely nothing. you need a judgment of a court to take real action. arbitration is alternative dispute resolution.

That is not true. Arbitration in small claims court is binding because it is similar to a default judgment (she did not show up, and I just had to show a little to prove the case in order to get the judgment). In any civil case, if a defendant does not appear any plaintiff is entitled to a default judgment. The judgment is definitely binding (as explained in the judgment). Any cases in that courtroom where the defendant did not show up were automatically sent to an arbitrator. Gina has 30 days to pay or else I can go to the sheriff to enforce the judgment.

If an attorney puts an arbitration clause in a contract, the parties are required to submit to arbitration and cannot go to court. That is not the case here. Believe me, it is binding.

marmarlove, If I ignored your FM it was for a reason. Now that we are finally getting over this situation you pop out mysteriously seeking help.
HMMM what happened, Gina is the bad person now? you weren't saying that a month ago.... you are shady to say the least. If you decide to file a lawsuit, that is your own decision and you are doing it alone. Good luck.

my dessicion and like I said I was wrong and

by this just as much.
