i just read the following in my health insurance booklet which affects our (post wedding) plans:An eligible Dependent includes:
•Your legal spouse who is a husband or wife of the opposite sex in accordance with the federal
Defense of Marriage Act provided he or she is not covered as an Employee under this Plan. For
purposes of eligibility under this Plan, a legal spouse does not include a common-law marriage
spouse, even if such partnership is recognized as a legal marriage in the state in which the couple
resides.

Yeah, is that even legal? Maybe call your insurance or HR department. I would be so upset/outraged too. So sorry you even have to deal with this.

I just read online that it IS legal as we are a private company, and a self-financed plan. Which means I have to ask for an amendment and pray they will do it i guess

I'm not totally sure how this will effect the insurance plan, but DOMA may be overruled by the time you get married. If that is overruled they may have to change this, because it seems like they are hiding behind the fact that the Federal Government doesn't recognize the legal status change.

Disgusting. Let's all hope DOMA is a thing of the past very soon. Hopefully that will smooth things over for you. In the meantime, talk with somebody at your company that you trust and see if they will amend it for you. I'm so sorry you have to deal with this. It should be a 100% NON-issue.Good luck!

yes this is what we are hoping for but it's just soooo frustrating!!! it makes the fight so far seem like a little stepping stone in the big picture. and it seemed so exciting at the time!

I did ask... so... TBD! But 90% of the employees are in states that have legalized or are very close to it (with overturning of prop 8 in CA) so it seems like a small chance they will change.

I am sorry you even have to deal with this. It should be a non issue. I hope you can appeal. Have you talked to a lawyer about your rights?
