had to cancel wedding

Original post by lazyc

My hands are shaking right now as I type this. I couldnt bare to put this in a post but finally got the courange to.

My FI and I realized that it is best to just put the wedding on hold, move in together and see if our arguments are stemmed from each other or from our parents. Our parents do not get along which creates struggles between us. He is a mama's boy and I have very controlling parents. We decided to move in together to see if our problems vanish. I called Jericho Terrace and sent a certified letter cancelling the hall. They will not refund my money and they say I will owe $30,500 if no one books our date, i'll have to wait the year and half to find out. If we take them to court, I will have to pay my, and their lawyer fees. If the room books for only 100 people, I will have to pay the differnce of 250 which was our min. i'm being so screwed.

I understand there is a suffolk county law, protecting us but the hall is located in nassau and I live in suffolk.. I booked the wedding only 2 months ago and its set for nov 17 2007... do you know what the particular suffolk law was called so I can research it and possibly bring my case to a lawyer. If you could reccomend a great lawyer, I would appreciate it so much.

If anyone is interested in that date- pleaseeeeee let me know ASAP! I will even include a reward if you book my date!!!

Re: had to cancel wedding

I just have to say I wish you the best of luck! For now, Forget the possibilities of lost money and concentrate on sorting out the relationship. It is a very smart move to decide this now before it gets too late. What reception hall is it? There is over a years time and the reception hall shoud be able to re-book in that amount of time, allowing for your deposit to be refunded (minus any difference should they lower the pp amount to rebook). Also why would you owe that much? If they don't rebook, you lose your deposit, not the total.

Hang in there, life will have a way of working out!!!!

I don't understand. I canceled my wedding with them with like 5 - 6 months to go. I just lost my deposit. They didn't make me pay anything else.

Id talk to someone else.

Re: had to cancel wedding

Would they give you a credit of your deposit to use towards a wedding at a later date? Ie, if after 1 year you want to rebook? I would think that as long as the know they are going to get your money some day they would probably be satisfied-though I don't know that you would even want to have any wedding their after all of this.

I've never heard of anyone who cancelled a wedding and had to pay the rest of the contract. I've only every heard of losing the money you already put down. Good luck...

did you pay in full already??

I can see you losing just your deposit, but having to pay for a whole wedding that didnt occur that you booked for over a year in advance doesnt seem right... I would read your contract carefully, maybe they are just trying to scare you.

good luck!

I wish it were that simple as rereading the contract. It i all there... in fine print- clearly stated. I realize that it is 'just' a buisness to them. They do not care about anyone or their customers.

Unfortunately, this is how JT does business...I had some second thoughts about having my wedding there and wanted to cancel, but we ran into the same problem. I even had my cousin (who is a lawyer) look over the contract and even she said it was pretty airtight.

The one thing that she did tell me is that in cases like this, people sometimes have luck arguing that they shouldn't have to pay the full amount that the reception would have cost, instead paying whatever JT's profits would have been. If there is no wedding, they won't have any costs associated with staff, food, beverages, etc., so they shouldn't get to make 100% of the cost as pure profit. I think it's a disgusting business practice, but they're a pretty slimy business (in my opinion), so I guess it's to be expected from them.

The good news is, there is still over a year until your date, so there's a great chance it will book. Also, it states in the contract that JT must make every effort to book the date. If they try to book the date for 100 people, you would definitely have a case against them that they didn't make a good faith effort to re-book.

I'm so sorry to hear that your wedding is off...I truly hope that everything works out for you!

I'm so sorry but.......

Are you sure you have to pay?????? Its over a year away, I could understand if it was this November......most places say you will lose you deposit upon cancellation and will only get it back if the date books!! I would read your contact very carefully before you pay them a dime!!!! That just doesn't sound right! And if you put a call in to a lawyer, most offer a free consult, so at least you will know you rights!

Good Luck!

I don't know if you already did but you might want to post about the availability of the hall on that date in the 07 chat room. Good luck!

Re: had to cancel wedding

You cancelled your wedding bc of your parents. How sad. I say move in together and continue your wedding plans. Did you guys fight like this b4 he asked you to marry him? If you did then more than likely it's not your parents. If you have only been arguing like this since you started planning the wedding then it's your parents. If it is your parents then you and FH need to sit down and TALK with each other and together stand up to your parents. As long as you back each other up you both should be OK. I hope it all works out for you.

Re: had to cancel wedding

i'm so, so sorry that happened. And I know I probably sound insensitive when I say this - and I really don't mean to be - but if in fact it's not meant to be, you're better off knowing before you get married.

That being said, I know where you are coming from. My FH used to be a mama's boy and now, even though he's not, his mom breaks his b@lls on just about everything which has caused tremendous strain on our wedding which then in turn, went to our relationship in general. I questioned myself, what I wanted, got cold feet, the whole nine yards.

I promise though - hard as it is right now - things will work themselves out.

Re: had to cancel wedding

I'm sorry to hear that! Call you suffolk county legislator. Trust me! I work for a legislator out in nassau and this is exactly the kind of thing I help people out with. He/She might be able to either recommend a place to go for legal advice or, they could contact the hall on your behalf. If there is a suffolk county law protecting you, they would know about it and how to use it to help you out. Give them a call!!!

I'm really surprised to hear it- I thought if you cancelled, you just lost your deposit. Don't give up hope!!! If nothing else, I'm sure someone else will book it.
