Help . . Do I have a case?
Do I have a case?Nightmare. . Yesterday I emailed my DJ that I booked in November 2011 for my July 3, 2013 wedding. I wanted to follow up and for him to send me a sheet so I can start filling out the songs I am using. My email was returned back to my inbox so I got a little nervous. I then went to his website which no longer exists. I tried calling the phone number and it rang and rang and went to voicemail. I found him on facebook and he had a comment posted that said sold my company to and some guys name. So now I am in pure panic. I call the number again and a guy picks up and I say hi I am trying to get in touch with so and so I have my wedding booked and I am unable to get in touch with him the guy says I am driving right now I just got out of church and I will give you a call back in 1 hr and my name is Anthony (

I'm not a lawyer or anything but I think most definitely you can bring them to small claims court. I'm sorry you are dealing with this. People are unbeliveable!! Hope everything works out.

FH seems to think that when you book a vendor, you don't have a case and you are just taking the risk that they won't disband or close. I don't know what is actually the case, but I think you can absolutely try.

It seems that there is so much fine print, you don't really know. I think not getting your MC is not a good reason, what would happen if on your wedding day he is sick or has a family emergency. Subitutions are somehow always in the contract. If you don't get all that you are promised, that sounds more like a breech of contract.
If this new company isn't good with communication, sounds like you might have to take the money loss and find a new DJ.
BTW- how are reviews for this new company?

There are no reviews for the new company. The new guy bought the company from the old guy . . I can't find a website or anything. I even tried googling the new guys name and have no response. Also, do you think I would have a case since I was not contacted that someone bought this company and they did not that previous owner had my wedding booked? Pretty much the new guy would have not showed up to my wedding because he had no idea that my wedding was booked. He only knows about me since I called him and told me I have my wedding booked.

I think you def have a case if the companyw as sold without your knowledge. I am pretty damn sure if a bride ordered a wedding dress from a store and they closed that she would have the right to know. Same as for any vendor.

I really don't know if you would have a case. I do think you need to start looking for a new DJ.This is so frustrating, good luck.

This sucks. You need to look for another DJ. Then you should probably have someone read over your contract (have any friends who are lawyers?) to see if you can get back your deposit. I've come to realize that contracts are more for the protection of the vendors than for us customers. I'm sure this guy has something in the fine print that will completely cover him. Unfortunately, you can't sue for crappy customer service.

Help . . Do I have a case?
I started my search for a new dj. I actually have a liw vendor that said he would honor the same price I was quoted from the crappy company!! My contract does not have any fine print at all. It lists that company name, website, phone number, date of occasion, location, our names, time, our address, phone number, type of occasion, type of music, approx number of guests, average age of guests, and every service we ordered as well as total cost, deposit, balance, that owner is to be our mc. It has the owners signature and my signature and it states The above persons agree the balance will be paid in full upon completion of the affair. Day notice is necessary if any changes in the contract are required. Desposits are non refundable. If affair is cancelled within 60 days of affair balance is due in full.

Unfortunately, it was not a Watermill recommended vendor. However, Our BM recommended him but we just found out on Saturday that he passed away.

I feel bad for you that you lost $500 but good thing for you and your FH that you are on top of things and found this out in March and not July. Its worth a try in civil court but more importantly, you got a new DJ who is nice enough to honor the last quote. Just in case someone on this site also booked with the horrible DJ, maybe you should make a new topic with the old DJ company name so they have a heads up too

another thing to consider is how much is it going to cost you to file in court and how much time will you have to miss from work? You have to weigh all of that against the 500 you might or might not recover in court. It could be in the form of a judgement that you never see for years if at all. This is just my opinion, sometimes your time is worth more, you have no clue have may times the case could be posponed.

Ok so I asked my FH who is a lawyer, I had him read your post. Basically what he said is even though you cant get in contact with him doesnt mean he is going to breach your contract. Aka he may still show up to do your wedding (although we know this is unlikely) you cant sue til after he doesn't show up on your wedding. So what he suggest s is hire a new dj and then when he doesn't show up sue the old company not only for your drposit but for the cost of hiring a new dj!! HTH!

So agree with this! If its just a matter of principal, then I can understand. I would be so mad also! But the time, expense and aggreviation would be a lot!
