We were nice enough to give him 45 days notice and now he's being a d*ck! We ask him about the security deposit and he says 'Well whatever is left after we walk through the apartment you get'. I understand how it works, but his wording worried me. There were plenty of things that we complained about that needed to be fixed (a leak in our bedroom ceiling) that he never took care of. And now he's going to try and be picky about the place? He never did ANYTHING for us!
And then we told him we need until the 18th (originally it was the 15th but we can't move in the middle of the week). He says 'you're going to clean the same day you move? I've never seen that happen'. WHAT??? What does he expect us to do? Paint?? The place wasn't painted before WE moved in. I'm going to vacuum and clean surfaces... what else does he expect? That won't take all day! We did it in our last apartment and we left it SPOTLESS!
I don't need this stress from him. I can tell there's going to be problems already.
Does anyone know any laws about this (like whats considered damage or unclean), so if he tries to jerk us around i can throw it in his face?

Re: I hate my landlord
a landlord cannot withhold your deposit for any normal wear and tear done to the property (ie. painting, shampooing carpets, etc.).
i know in new jersey, a LL has 30 days in which to return the security deposit, and if he withholds any part of it, he must certify a letter to the tenant specifying the reasons why he is withholding the deposit. i would check NY laws to see what it says about this.

Re: I hate my landlord
Our last landlord was just as evil so we told her(after we had moved) to keep our security as our last months rent however we never had a lease so I'm not sure what your lease says. She called a few days later to curse us out saying the apt was damaged. Meanwhile the place was a dump from the begininng. I had painted a few months before we moved, the walls were covered in mold and I couldn't take it anymore, she never offered to help us pay for it. DH lived there a total of 7 years and the only thing she did to upkeep that apt was replace the windows. Meanwhile the walls in the kitchen were coming up, the carpet was so old it was turning white, the plumbing was awful the electrical needed updating, we were constantly blowing fuses if we had more than one thing plugged in. After her rude phone call we blocked her from calling us again and haven't heard from her since.

oh, and DH had to cut a hole in a screen for his airbrush vent thingie. Well we've been planning on getting a replacement before we left. We're not scumbags. So he tells DH about it, so he goes I know, I had to because the screen doesn't move... then he says 'well why didn't you just take the screen out?' DH said 'Because then bugs would come in'. Back off!! We're going to replace it! And if we don't that's what the deposit is for. I mean, how much could it possibly be?? I've seen them not more than $50 (for the kind we need).

Yeah, but landlords can be a real pain in the ars and if he doesn't give it back to you then you'd have to take him to small claims court to get it back (which is a big pain). Just make sure you document everything well...take tons of pics after you move your stuff out.
Our landlord is a big pile of c r a p also, and we're just assuming that we're not going to get any of the money back...and he's such a PITA I would rather forfeit the $$ then have to even see him in court.
