hi! question for all your lawyer girls out there my FI are getting married in June... and we are looking to put an offer in on a house soon. now.... if we get the house and go for closing, what is the best way to handle the names on the deed? he has more savings than i do so he will be making the down payment... and i won't be putting money toward the mortgage until i move in after the wedding. should i put my name on the deed now, or wait and add it after the wedding?? you never know what will happen in the future, so i just want to protect myself.... thanks!

I'm a lawyer---if you don't do it now, do it very soon after you are married.

Yes, that is true if you want to add your name to the mortgage. The bank would require an application fee, credit check and of course the closing costs.
I am not a real estate lawyer but I did have a name removed from my mortgage after owning the place jointly for several years. However, you would not need to get your own lawyer (unless you just want to) since the bank will have a lawyer to do the closing. All I had to do was go sign a ton of documents with the bank's lawyer.

I think you can be added to the deed without being added to the actual mortgage.

Re: LAWYERS: NWR Question...
What a small world-I am getting married in June and I am a lawyer who is also going to close on a house this Friday!! Congrats! Definitely have your name on the title of the house-why on earth wouldn't you? It should not matter to you future husband that you didn't put down money. On the other hand, if you aren't on it and God forbid something should go south (which of course will never happen) depending upon how long you have been togther (and especially if you have children at that point), you still would be entitled to some of the proceeds of the house should you decide to sell it (equitable distribution). But-to avoid any future legal snafoos, make sure you are on it. Why on earth wouldn't you be?l
