Re: Lying under oath
. Lying while under oath is against the law and is punishable by a prison term. Usually it is difficult to prove perjury.

Re: Lying under oath
You have proof well then I would definitely say some sort of prison term how severe is this situation?

Re: Lying under oath
He has been causing enough aggrivation for my mom me my sister and brother for 5 years now. They just had a meeting in court today and it looks like his lies and schemes are fooling everyone. We have the proof for actually more than one lie under oath. My moms attorney advised her not to use it!!!!!!!!!! I think it shows bad character and I am sick of him getting of the hook for everything and making others suffer. Who do I tell?

Re: Lying under oath
If your mom's attorney is telling her not to use it, I think it could mean several things...1. it will somehow reflect poorly on your mom or her case, 2. the penalty is possibly little more than a slap on the wrist (a fine maybe, I don't know), or 3. your mom should ask another attorney their opinion.
I'm not a lawyer, so I don't know for sure. But the seriousness of perjury probably varies depending on the nature of the lie and the type of case it is.
