Haven't started looking yet but DH and I talked about getting a M/D house for various reasons. When I search online such as MLSLI.com I found a lot of possible M/D. When they say possible does it just mean that it is but the owners don't have the proper permits? Also for those house hunting now do you find there are a lot of M/D houses on the market that aren't necessarily advertised that way?

Re: M/D Houses
Our house wasn't mother/daughter, but it did have an apartment. It wasn't advertised that way though. If you notice on MLSLI sometimes it will say there are 2 kitchens. That is what we saw on ours. It was a legal apartment at one point, but at the time the homeowners were using it as a den. If we file the permits it again could be legal. Right now that is where we are living while we renovate the house. I am not sure if we are ever going to rent it or not, but at least we have the option. I think m/d have higher taxes though.

Would you have to make the spare apt. legal if it's for family?

I think if it's for anyone to live it needs to be legal. If you don't put a stove in it, you can have someone live there w/o having to make it 'legal' since it's not really an appt.

I believe that if it's a second floor apt. it could be legal w/ permits. If it's a basement apt. There is no way it can be a legal apt. It's supposedly illgeal for someone to sleep in an underground area.

We are thinking about renting too. We would probably try to make it legal if the taxes dont go up too much.
We didn't want to get in hot water for not claiming it on our taxes
