Option 2 COULD be ok as long as you get proof that the diamond is the cut, carat, color etc. that he states it is. That will then bump up your ring appraisal since most of it comes from the diamond's worth anyway.
OR
I'd try selling it and see how much you could get for it.
i'm leaning towards telling the jeweler that we'll do option #1 (he gets ring and we'll get the money) BUT we had better have the entire payment back within 3 months ... that's 3 months more than this idiot deserves! oh, and i'd obviously get this in writing from the jeweler too ... is that a good solution? or am i being too nice?
umm.. your being too nice. So what if you get something in writting. That can only take you so far if it's not a legal document. He can a) switch diamonds on you, b) accidentally 'lose' the ring c)Say he can't sell it d) Sell it at a cheaper price and then tell you, 'I gave you your $ back.. I couldn't sell it for what your FH paid so this is better then nothing right?! I'm doing you a favor.'
DO NOT DO OPPTION #1!!!!!!!!!!!!!!!!! too many things can go wrong!!!
...but if you insist....get the advice of a good lawyer NOW!!!!!!!!!!! ...not when its too late

Re: my e-ring ... the saga continues
definitely not option 1. he hasn't done right by you yet, why would he now? another thought, as this guy sounds super shady, talk to an appraiser whom you trust, if you must exchange the stone, see if you can pay them a small fee to go with you to check it out right then and there before you trust this yutz again. i'm so sorry for the headaches hunny. FH's cousin sent him to his jeweler, not the lady my family has been using for 20+ years. the 'deal' he was cutting him wasn't at all. mine appraised for about $100 more than what he paid (that's not a typo). my jeweler told us she would have done it for about 2500 less or i would have had a much bigger stone for that money. i was so far beyond pi$$ed. and to make matters worse, we got engaged on block island. we were there several days and i had been wearing the ring on the beach. the stone felt a bit loose but we went to a jeweler there to get it tightened and she said they wouldn't do it so well because they didn't know the cut of the stone. long story short, i had been swimming in the ocean with an uninsured loose diamond for 3 days, that was apparently about to fall out. my jeweler had to re-set the whole thing.

wow!!!
I wouldn't trust this guy at all!!!!!!!!!!!! End your relationship with this jeweler as fast as possible..... Get the new diamond from him, and that's it from him...... (although, I agree with bringing an appraiser with you if you can)
Then go to another jeweler and get your money's worth there!!!
Use teh diamond, change the diamond, use the metal, change it, whatever, but make it a NEW ring with NEW sentiment and karma attached to it!!!!
DO NOT DO OPTION #1!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
