By law do you have to give a ring back, if so does it depend on when you got it or not? Please help, I need to know asap.

I posted the same thing a few weeks ago,i think it depends on who calls off the engagment

I depends on who calls off the engagement. Was it given to you as a gift??? I say no matter what do not give it back. You have given enough of you. I would never give back a ring. As Stef would say, you would have to pry it off of my dead hands b.c that is when you would get it back over my dead body.

I could be wrong but I thought legally the FI has a right to recover the ring except if it was a gift, (ie., bday Christmas, etc)

Yes...if the marriage does NOT take place, you have to give the ring back...regardless of who called it off.

By your question I'm guessing you're having a rough time again.......

I hope you are OK.

Re: Need an answer ASAP, urgent...

By NY State law you are required to give it back, unless it was given as a gift (birthday, valentines day, christmas)

Someone posted the same question and I posted a few websites for them in the thread. If you do a search on google you will also be able to find the websites.

*marches around with sign* Do not give the ring back* Why should he or any man get it back, what about all the years you spent with him in the relationship. I am sorry he would have to take me to court, I was not giving it back, I told Roger that already too.

I told FI if anything ever happend, he can have the setting I want the diamond. Its my mom's. She gave us her e-ring (I am an only child so it was going to be mine anyway) and he had it reset.

But legally it does have to go back to him.

Well, I guess I am a law breaker, arrest me but I am going with the ring on my finger. I would sell it pawn it before I gave it back. What if I say I want all my years back.

Chippa, that was nice of your mom.

well..now are we talking after you get married. I feel that if you are married, then you should keep the ring.
But if the marriage NEVER takes place.. he should get it back.

As far as I knew (this is not something we discussed in law school, but we should've), you are required to give it back.

However, I WOULDN'T

MAKE HIM SUE YOU IF HE WANTS IT....MAKE HIM SPEND A TON OF $$$$$ ON ATTORNEY'S FEES BEFORE YOU GIVE IT BACK!

Re: Need an answer ASAP, urgent...

well it was a new year's present, then again you cannot follow me, b/c you see my mindset already.

Diane whether before or after marriage, once its on my finger its mine....all mine you hear me, there is no giving back to anyone. Except to upgrade of course

Re: Need an answer ASAP, urgent...

Good point Shamma.

My Matron Grace her parents are divorced and her mom kept the e-ring. Years later when Grace got engaged she wears her mom's e-ring (her mom also passed away a few years ago)

So I guess for symbolic reasons one would want to keep it.

It was definatly nice of my mom. I told FI if we have a daughter I want to pass it on to her.

Re: Need an answer ASAP, urgent...

I don't want to keep it b/c it symbolizes what an ******* he is by why should I give it back after the **** he put me through? I got it for new years day, can't I fight that.
