NWR-any lawyers fam. with real estate?

My DH got owns a house in riverhead that he rents and we are looking to sell. the tenants pay their rent on time every month for about the last 18 months, then suddenly stopped last month. I am beside myself, the mortgage that we now have to pay for that house (their rent!) is breaking us! Where do we turn first? If anyone can help guide me, tell me what steps to take and what our rights are, it would be greatly appreciated!!

post this on the weddingchannel NY board. there are lots of bride lawyers on that site. did you go and speak to the tentants? I would go to the house and ask them for the money. I am not a lawyer but I know it is really hard to evict someone. Can you change the locks and force them to pay?

I think this could get very sticky. Did you ask them about it? What was their reasoning? They may be moving out. Sme people just don't pay their last months rent and let the security take care of it. Becarful because it can be very hard to get someone out.

they are probably moving out.. is it a legal 2 family?? if not, then I'd speak to them and then if necessary ask them to leave...or if they give notice then put an ad in the paper, or go through a RE and get that apartment shown and rented..

Also, if it is an illegal 2 family, I suggest that you be careful with what you say, I don;t know the tenant, but if he/she is an A$$ then they can report you to the town..

First of all contact them and ask them if their is a problem..


Then if within 15days of the rent being late mail them a letter with a 5% late fee.. If you still don't hear back from them after this call an attorney..

You then can have them evicted with in 60days!!!!!!!

First, I would talk to them to see why they're not paying rent and if there is a problem. Is their lease terminating? If you haven't sent them (certified mail) a notice with the late fee, you should do that right away. You need to keep all this documented. Trying to get rid of a tenant can be very ugly and messy. Even if you take them to court, it's a long process. Good luck!

It's not a two family at all, they rent the whole house. We went there when the rent was 2 weeks late, (its all the way in riverhead) and she said it was in the mail. Now, we just paid the bank the 2nd time the mortgage payment without getting the rent. We call 10X a day, and get nowhere. We've already sent one certified letter. I can't tell you how heartbreaking this is, to know that we are powerless! All of our savings is going to pay someone elses rent! I don't know about changing the locks, I don't know what our rights are! this is such a long story, because DH's brother, who is now estranged from the family, got him involved in this and then skipped town. blah blah. sorry for not posting on the NWR board!

Do they have a lease?

If not then they can get thrown out NOW!! No lease no rights.

TRUST ME you are not poweless..
If they have a lease look for what it says for late payment..
Tell them you want a rent check with 5% of a late fee overnighted to you TODAY if not you will have them out by the 30th of the mt!!!!!!!!!!!!!!!!!!!!

You as the landlord have the right to terminate the lease and have them evicted if they do not make payments on time. You have to send them notice that you are terminating the lease because of this reason and that they need to vacate and comply with the notice, otherwise face legal actions.
