Re: NWR: anyone ever been sued?

I was sued when I was 19. I hit (more like tapped) someone from behind. Long story short...they tried suing me for 1 million $ and my dad for 1 million $. We met with a judge in a small court and after hearing both sides and their false claims the case was dismissed and they got what they deserved NOTHING!

I hope everything works out!

I have never been sued, but I sued two people from different accidents because I did have injuries and when the No Fault stopped covering it, I was paying out of my pocket. You have a pretty new car, so more than likely you have the insurance coverage for it so everything will be handled through your insurance.

I havent, but I work as an adjuster who handles injury suits all the time. FM with any ?'s

Dont freak out, its usually your insurance company's responsibility

Re: NWR: anyone ever been sued?

FH sued after a terrible accident where a car hit him and caused extensive injuries. It happened in GA and they have much stricter laws down there regarding how much you can sue for (i.e. you can't get a million bucks for a broken finger nail like here in NY!). It was all covered by the other person's insurance company.

You can sue for actual damanges and potential damages that could occur in the future due to the injuries. (i.e. problems that might develop years from now).

Good luck, I hope it works out.

Your insurance company will work with you. Don't be too worried until you have all the info from them.

well it was a three car accident - a fender bender - one of the people in the accident i work with (her car just has a few scratches on it) she got a letter from the womans attorney asking for her insurance information.....she called up the womans attorney and told him that she wasnt giving him any info everything he need is on the police report and she told me he was being a real jerk b/c he wants her as a witness.....i havent gotten anything yet in the mail and geico hasnt informed of anything - i thought it went through insurance, so i dont know why her attorney was contacting the other person involved in the accident? the police report has all of our insurance info....the lady was def faking or exaggerating and i heard her family is 'sue happy'.....so im freaking out......can i be sued personally for this? or only through insurance?

I wouldn't worry too much, unfortunately this happens all the time. I used to work for an insurance defense firm and had to depose people claiming minor injuries in these minor fender benders. Unless this person was sent to the hospital with irreparable injuries and will be scarred for life, the insurance company will take care of everything and you will not be touched. That's why we have car insurance. This person will MAYBE get a few thousand out of your insurance company, if that, and it'll be the end.

That attorney is contacting your friend because he's trying to build a case (of which he has none). Definitely tell your friend not to speak to him period. Even if he send another letter, the only time she would need to respond is if she was supeonad (called in) by the court , if it even got that far, and I'm sure it won't.

It will be through your insurance....what was the damage to the car? You also may not be sued at all b/c the idiot may end up just trying to collect No Fault benefits of his own.
But Geico will handle it

The accident occurred in NJ, so I don't think No Fault is a factor, unless NJ has some no fault equivalent.

Ha, i don't know if they do. I'm in house at an insurance co - its all i deal with all day!

For just a fender bender she is going to get very much. I'm sure the injuries she is claiming is whiplash and other back injuries.

thanks guys

i mean i would feel HORRIBLE if someone was injured for real - but what upsets me is that she was only rear ended - she had a 99 car and it was small, so my truck did do some damage to it and it had to be towed.....right away she said she was hurt and wanted an ambulance - then she started searching her car for her cell phone - she was bending down, she was looking under her seats, then she cleaned out her car, and carried all of her stuff into the ambulance - once she did find her phone she would not get off of it to talk to the police or EMS - i got the impression that whoever she called was coaching her - even though she was saying she was hurt she certainly wasnt acting like it - how was she able to look under her seats for her phone, clean out her car, walk around and then walk into the ambulance while carrying bags!! the woman i work with knows of the family and she said that they have a reputation for suing people - im not sure if thats true or not but she did not seem legit - so it makes it much more aggravating.....

thanks again, you are all making me feel better but i still cant help but be nervous!

if you can prove that this family has a reputation for suing people that would be an asset to you. All court documents are public record, you could even get info all by yourself. All you need is her name and/or DL#. Judges do not check the history of litigants and their SUE HAPPY history prior to entering the court room.

ETA: You have the police report and insurance info that isa head start!

I was! They sued me for, no joke, TEN MILLION DOLLARS! They settled out of court and my insurance company paid them I think $2500 or something to that effect.

Re: NWR: anyone ever been sued?

call your insurance agent and tell them that this lawyer called asking for info they will call him and handle everything. you shouldn't have to do anything. it should be all handled with the insurance.

only thing with this is- if its settled its very hard to prove- if the case went to court, it would be recorded- but thats very rare in accident cases. but tell whoever your lawyer is (your insurance will hire & advise you of who it is) and see if they can find out.

That's not necessarily true. Even if a case was settled, all the documents leading up to it (which would be things like pleadings and motions) would be on file with the court. In New York, they are just starting to put these things online. I have no clue about Jersey. If Jersey isn't online, you'd have to go down to the court in Jersey and ask the clerk where you can get 'closed records.' Then you could say you're looking for any closed records for 'Person X'. Hope that helps!

That's typical. That was the amount my lawyer put on my claim for first jerk I sued and caused me thousands in medical bills out of pocket. Clearly you don't get that amount. I'm lucky I got back what I paid in medical bills.
