Unless they are looking for a huge amount it should be taken care of by your insurance company

Re: NWR: anyone ever been sued?

i just dont understand that they can refuse to get in the ambulence..then claim no injuries and small dent on the report..and then 55 days later say they are injured

it just doesnt make sense to me

i hope you ( and i ) get this worked out

depending on the situation and how bad it was but yes it does happen. I know somebody who sued and they had every right to but this was a bit of a different situation bc it was intentional . But even in other situations yes depending if a person got hurt or not

well it was a three car accident - a fender bender - one of the people in the accident i work with (her car just has a few scratches on it) she got a letter from the womans attorney asking for her insurance information.....she called up the womans attorney and told him that she wasnt giving him any info everything he need is on the police report and she told me he was being a real jerk b/c he wants her as a witness.....i havent gotten anything yet in the mail and geico hasnt informed of anything - i thought it went through insurance, so i dont know why her attorney was contacting the other person involved in the accident? the police report has all of our insurance info....the lady was def faking or exaggerating and i heard her family is 'sue happy'.....so im freaking out......can i be sued personally for this? or only through insurance?

FH is actually in the progress of being sued for an accident he was in back in Jan of 04!!! They just sent out info on it a few months ago to us! A lawyer was assigned to him and hired by the insurance co. the lawyer said that there is really nothing for us to worry about right now, it can take up to a year for them to gather all the info they need before it will even go to trial, and in most cases it never gets that far anyway. They told us not to really worry about, but I still do.

Its funny now, I got sued for a million dollars because a pedestrian walked into my car. He was drunk!! I have GEICO they took care of everything I only heard from them when I had to fill out paperwork telling my side of the story, and when it was over they called to tell me case was closed. He got $30,000!! Don't worry, you probably won't even have to go to court, its usually settled b4 it gets to that point.

to fix the car it will be through insurance. But some people will sue over injuries and can take it to court, again depends on what measure they take.

He got $30000 for being drunk and walking into your car? Man I'd would be a millionaire if I sued someone everytime I got drunk and walked into their car!!!!

Re: NWR: anyone ever been sued?

My fiance was sued and his brother did sue ppl, and I worked in a lawfirm for negligence for a long time.

Dont freak out...take a deep breath....the most you are going to do is sign some papers, you might get called to an EBT - but its really a conference. The woman who sued FH claimed injuries, and they atty found out she was lying and it was thrown out.

FH bro has had some bad shoulder probs, legit- sued and got about 50k after atty fees...it was from ins $

if you are still nervous consult with an atty for free.. my old boss does free consults. fm me for his name and address... in coram and deer park

Re: NWR: anyone ever been sued?

I was sued. I rearended someone when I was 18. He was also 'sue happy' and after I was sued my attorneys uncovered that he had previously been the plaintiff in 5 lawsuits where he was rearended. They called him a 'swoop and stop' driver. He had no injuries and his car had a slight dent, while my car was wrecked.

It was no big deal. They served me at my house and I called my insurance and they have a law firm that handles all their claims. The next time I heard about it was more than a year later when it came time for my deposition. I was deposed at the court house in Central Islip, but often depositions take place at the offices of one of the lawyers.

A few months later the law firm called and told me the case had been settled for $12,000. That was it.

It will be through your insurance....what was the damage to the car? You also may not be sued at all b/c the idiot may end up just trying to collect No Fault benefits of his own.
But Geico will handle it

The accident occurred in NJ, so I don't think No Fault is a factor, unless NJ has some no fault equivalent.
