Prenup

Re: Prenup

i can totally understand why you were upset that he wants one ... but don't be upset by it ... it's actually something Suze Orman (a financial planner on tv and whatnot) recommends that all couples have.

Of course, i'm still not sure about me and FH

Re: Prenup

I brought it up because I wanted one for a weird reason. He bought his house, 2 cars and a boat before ever meeting me. I have a bit in assets but not a house or anything although my mom's house is willed to me. I wanted us to have one because should things ever get bad between us I want to know he's not with me out of fear that I'd try to take everything. He seriously had no interest in this though.

Re: Prenup

nope verbal tp just leave each others' assets alone...theoretically, I am worth more because of FH's debt so I'd make him sign one lol

Re: Prenup

FH's financial adviser actually insisted that he set up one. FH was the soul beneficiary of his dads & his aunts life insurance so he came out with a large sum of money. However we are not going to do one. We both have each other listed on our 401k plans as well as on various mutual funds & cd's. we will be together 10 years by the time we say 'I Do' & we both feel that its really not necessary.

I asked FH if he wanted me to sign one. He has a couple of houses and some money and investments that he had before he met me. I thought just in case if he want to protect his property. He told me no and has worries about it. But I was willing to though

LOL same here!!! We have no assets besides 401(k)s so I don't think it would be an issue.

Re: Prenup

i'm really not sure. i'm bringing a lot of assets into the marriage, and he's bringing a lot of debt...so it would make sense. at the same time, i trust him so completely that i know he would never take anything that didn't belong to him...so it's sort of a hard one. my parents want us to have one, but at the same time they totally trust him, too, so i don't think they would insist.

I understand why you are upset, but if FH wanted me too I would.

NO ONE goes into marriage thinking they will get divorced. NO ONE things their fiance will stoop that low but look at all th e messy divorces? look at all the spite in the world.

In reality, if you are happy forever and never get divorced, its useless. It had no benefit, did no harm.

If something happens and you get divorced and things are amicable, again, no harm, no benefit.

If you get divorced and their is bad blood, on either side, it protects you both. there is no way it caused the break-up but it will sure save some potential havoc.

we all want life to be sunshine and rainbows, and for some it is, but for others its not.

JMHO if he wants it, sign it. It will bring him more peace of mind compared to the sadness you will feel

we aren't getting one bc we don't have anything. if he asked me to sign one, i would. it's not that i don't believe in our love, it's just that if he had things that are rightfully his i would want him to protect them. you never know what could happen between 2 people who once said that if they ever split then they would never take something that didn't belong to them...

i see why you're upset though... the whole getting up and leaving him comment was a little on the strange side. i'd talk to him and say that that bothered you

Re: Prenup

FH and I are probably not doing a pre-nup but if he insists on one, I would most likely sign it.

We both have property/assets that we are bringing into our marriage. He bought his home before he met me and has at least 65% equity in it. I bought a condo about 3 years ago before I met FH and also plan to hold onto it until I build enough equity and use it to sell it and apply the proceeds to my student loan debt. We also have cars in each of our names (he has 3 cars including an antique) and my parents have will-ed their house to me, so I think a prenup won't be a bad idea.

You can never predict the future in ANY marriage. In 10 years, things can go south. You hope the word 'divorce' or 'legal separation' will never enter your mind when you get married but the reality is that in the US, a good percentage of marriages go south. Its just life - and you work hard to ensure that you don't become just another statistic.

Whats also good to know is that prenups are not completely 100% enforceable in court. A court views prenups as agreements between husband and wife so that if 1 party decides not to comply with the terms of the agreement, the Court can't really step in and interfere with that contract.

For that reason, I told FH that I wasn't eager to sign a prenup since the legal effect wasn't the same...but I think for most couples, a prenup is a smart insurance policy to have because finances can really be a nightmare to deal with should divorce be a possibility.

My FH asked me if I wanted one b/c i'm bringing a lot of assets into the marriage. I am not going to do it though.

same here. i owned my co-op before we met and it was sold for our house, we have talked about 'what would happen' and we chose (really I did I guess) not to.

Re: Prenup

FH and I aren't bringing a significant amount of assets to the marriage so we aren't signing one.

but as a lawyer I have drafted pre-nups for clients in the past. FM me if you want to discuss it. I don't think they're a bad idea generally. nobody wants to think about divorce but divorces do happen and it doesn't hurt to be prepared in advance.

Re: Prenup

FH and I signed one before we bought our house because it was a condition for my father to give me money towards our house. FH and I agree that we would sign it and put it away forever. My father is just trying to protect me...so

no we are not having a pre-nup. we havent even talked about it but we dont really have anything that we would fight over if anything ever happened.
but i would definitly be upset over it too. sorry...

I agree....we haven't discussed a pre-nup because FH is so laod-back he would probably be like 'Take whatever, just leave my x-box'...
