I asked this question a while ago but Im gonna ask again cause Im freaking out about it again and I dont remember what was said about it. I have tax debts from 2002 hanging over my head. I havent been able to pay them or even send small amounts of money on it. Does anyone know if this is going to carry over to FH?? Will they start garnishing his money once were married or does that only happen if I change my last name? This is really lying heavy on my shoulders cause I dont want this to burden FH when its my problem.

I deal with credit on a daily basis, & once you are married credit reports do not become linked. When you apply for car loans, mortgages, etc. together then your ss# & his ss# will appear on each others credit reports, but they still arent linked.
i.e. your credit report will show your ss# with FH ss# under yours with a asterix next to his number. No where on your report will you find his credit profilie information.
If you have joint bank accounts then yes the government can put a lien against the account for the amount of money you owe. It is good that you dont have a bank account because they will definetly put a lien against it.
Your financial obligations do not become eachother's financial obligations once you are married.
When you file your taxes you can file separately but your status on the return would be 'married filing separetly', & one of you file head of household....u should let FH do this because it would benefit him more since you owe $$
If you get a refund the IRS will apply that to any back taxes owed.
Hope this helps.
This ^ definetly sounds correct. As long as you don't have a joint account they can't come after your FH. Kind of like if you marry someone who is paying child support they can't garnish your check just because your married to him.

Re: Previous Debts before marriage...
You need to set up a payment plan or do an offer in compromise. Offer in compromise I would suggest contacting a CPA.

Thank you for the detailed responses. I like knowing I have options. But I know the most important thing is working something out with the IRS. I doubt theres a way Ill be able to offer & compromise since I owe such a large sum of money. I think I may have to hire someone which ***** too cause then Ill owe them money too. Your responses are greatly appreciated.

doesnt matter how much you owe, you can do a payment plan...or if you agree to pay it all at once theyll take off a decent percentage that you owe. At first i had asked for a payment plan then when she told me how much off i would pay if i did it all at once i took that option. If its that large of an amount definitely think of the payment plan though, you can do it yourself just call them and talk to them, many of them will work with you and set something up that is reasonable. When it comes down to it they want to get their money and theyll find ways that will be easier for you to pay and also to do it quickly

I believe FH has some debts (school loans) which I told him to take care of BEFORE the wedding bec I will not be paying for that. I have everything paid off so Im cleared.
Yeah, you have nothing to worry about with his school loans debt. When you have tax debt, the gov't can go after your money without your consent, no one can do that when you have student loans. You're safe!

Re: Previous Debts before marriage...
if you want i have an accountant that you can call @ my office to ask for advice. FM me for more details.
good luck!!
P.S. the ladies were right about filing head of household, you need a dependent in order to do this, so once you guys have children you can look into that.

SO Im hoping they wont be able to touch his money if we file seperately. I plan on contacting someone right after we get married to get it squared away. I have to take care of it someday!
you should get on a payment plan w/ them ASAP even if it's $20 a month, at least you are making amends to the debt and they won't touch him.

You can look this up online. As long as you keep separate bank accounts, and dont have Loans together. You will be fine As soon as you and you FH have a joint loan, your debt is his debt

Re: Previous Debts before marriage...
Mama dont wait until AFTER you get married, get that settled up now, trust me. Even if its paying 20 dollars a month.....its better then having interest racking up like crazy and them going after every asset you and FH have/will have. I've been through this....the IRS doesnt !#$#%#$^% around, lol.

Re: Previous Debts before marriage...
I understand that but my response was to someone who said to either file seperately or file head of household and all I was saying that is if you are married you cannot just file HOH. And in order to file HOH you have to claim the dependant on your tax return. You cannot also just file an injured spousal claim that really is irrelevant. I prepare taxes on a daily basis and really the only option is to settle with the IRS they will stalk you until they get some if not all of their money. And this is for anyone who recieves a 1099-MISC from an employer... make sure you put money aside for taxes bc not everyone is made aware of that before they do the work and when they file taxes they are shocked that they have to pay the taxes
