Here is my thought.

I'm slightly torn, but I'm more for it than against it. I think that if a person feels they have the right to murder someone at random, they deserve to have their life taken by the court. HOWEVER, I feel that the decision to handout the death penalty should be unanimous. Not 4 jurors say no and 5 say yes... There should be NO DOUBT that the person being tried committed that crime and that the death penalty 'justifies' the action.

Criminal trails are unanimous verdicts. all by unreasonable doubt. So, that's really not the issue

so every single juror has to agree that the person is guilty? you don't think that jurors are sometimes persuaded into a different verdict if they are the minority vote?

This probably happens alot unfortunately, ESPECIALLY with cases that go on for such a long time. I mean some people have to be away from their families for a while and I think if there is one person who does feel differently, many times that person might get persuaded by the others or they might just go with what everyone else feels so it doesn't drag out more

after the verdict is read the judge polls the jury and asks again if they are sure that this is their verdict. If someone even hesitates - the judge can dismiss the verdict. Or they can say they can't agree and have a hung jury. If people felt strongly enough, there is other ways to go about it.

Yes i understand but many might not hesitate. Or sometimes the others can persuade the person. I am sure many times they dismiss the verdict because of this but probably quite a few times where it doesn't happen

I happen to agree.

As for the families of the criminals.. I feel bad for them. But truly I am not as concerned for them as for the victims.

Which I think is totally normal. I mean - of course the family of the criminal is in a state of pain that is unimaginable, but society's first concern should be the victim and their family.

i agree - but just imagine you are the mother of that person - knowing you gave birth to them and that you created that monster - knowing that the person you loved with all your heart could do such horrible things - i mean that has to really mess someone up - and then do you stand by them? or forget them? as a parent you must be torn - do you still love them because they are your child? how do you just let them go - imagine you were the mother of a serial killer - how do you live with that? its just something that isnt really discussd or thought about thats why i brought it up...

but anywho - i dont know exactly how i feel about captial punishment....sometimes i think a life sentence is worse on the mind - being forced to live in jail, no choice, no freedom, treated like an animal, no visitors, no real life

I also think that, unfortunately, becoming a serial killer may have absolutely NOTHING to do with the parents or how the child was raised. I truly believe that a child molester/serial killer/rapist/etc. has something actually chemically wrong in their brain that they are unable to stop themself from doing something this is so obviously and clearly wrong to the rest of society...

yes i agree...that is why we have the term 'pyshopath' (dissocial personality disorder) or also sociopath. (SORRY I WAS A PSYCH MAJOR). People who know what they are doing is wrong but still do it because they get mer joy out of it. It is disgusting but there are people like that in this world. But other times there are people who clearly are unable to stop themselves from doing something but they think they are right in doing it- they are sick in the head. Although psychopaths are sick they know what they do is wrong. And you are born like that- it is an illness and I don't think any parent could control that.

It can also work the other way too. I have studied quiet a bit of these cases and jury remarks about the case. Almost every single one of them, years later, say they were still sure about their decision. Of course stuff like this happans but we have to put our fate into our peers and justice system. If you say this about these cases, you can say it about every case and then where would we be?? Always questioning verdicts and decisions. I will tell you that I honeslty question more decisions from judges then I do verdicts from juries.

also what you have to understand is that prosecuters do not charge someone with 1st degree murder if they do not have well beyond unreasonable doubt that this person committed the crime. There's a process to even put the death penalty on the table. Then there's 2 verdicts. First the jury has to decide gulit then there's another verdict to decide the death penalty (or the judge does it- depending on the state and the judge) So it is not a simple process.

If you dont mind me saying, I agree that a parent can not control a mental issue their child has, however I have learned in all psy classes that with proper help ( which only the parent CAN control) a child with any mental issue can take precautions for their future. This is not at all an attempt to blame parents at all, but it has been proven that the majority of the sociopaths or pyshopaths have issues that were not taken care of properly from a young age.

agreed, however, it is often too late when a parent realizes their child has a problem... look at the kids from Columbine... After the shooting everyone noticed a 'problem' but no one ever reached out to help them... not school counselors, teachers, family, friends

Of course definitely can work the other way around. I think though if we think about it, its very easy to be confused. How many of us can hear all the details about a crime and still not feel 100% strongly about a verdict. I know theres been times I hear all the details and certain facts will make me think 'OH he/she definitely did it' but then you hear another thing and it makes you question that now. I don't always question verdicts, it was brought up and i said that i agree that a juror sometimes can probably be persuaded. Nothing even against the jurors but regarding my statement above, sometimes other jurors can point out certain things and all of a sudden make them question what they were feeling. We're all just human, being undecisive is normal, hearing certain details can all of a sudden question how you feel. I think even those that will go in the first day and feel somebody is guilty for example, felt that way the entire time up until the end can go home or later down the road think to themselves if they were right or not. Its not that I am even saying these people are wrong or I dont believe in the justice system but these are human beings and emotions change very easily and I think it's very normal for someone to be undecisive.

I'm very indecisive and would make an awful juror... the only way I'd be able to find someone guilty without having ANY doubts was to see the entire thing caught on film with the murderer looking into the camera giving his/her name, address and social security number... Obviously, that is not the case ever, so I'd have a hard time picking a verdict, that i know for sure.

no i don't mind at all...we are all allowed to have our opinions and i like hearing others especially if they disagree it gives me more knowledge on the topic.

And I do agree with you. It is definitely true that the parent needs to take the first steps into getting their child the help. That can definitely help the child's future!!! And it stinks that unfortunately there are parents who dont care, don't want to or just plain are in denial of their childs behaviors or issues and they don't get those services for their children. And it just so happens that alot of the sociopaths are those who were not helped younger in life!!! I guess what i was saying in my last post was that the disease/illness can not be helped. But there are precautions that parents can take yes I believe that. And if i was ever in that situation i hope i would help my child instead of giving up hope!!

Yes i understand but many might not hesitate. Or sometimes the others can persuade the person. I am sure many times they dismiss the verdict because of this but probably quite a few times where it doesn't happen

I think even for an undecisive person, and if they felt strongly one way the fact that your decision will effect the rest of someones life will make you question yourself. Maybe even if its a passing thought in your head and you don't admit it outloud.

Look at something simple such as marriage lol, how many people say 'oh god am i doing the right thing' its human nature for us to ask ourselves that question a

i agree - but just imagine you are the mother of that person - knowing you gave birth to them and that you created that monster - knowing that the person you loved with all your heart could do such horrible things - i mean that has to really mess someone up - and then do you stand by them? or forget them? as a parent you must be torn - do you still love them because they are your child? how do you just let them go - imagine you were the mother of a serial killer - how do you live with that? its just something that isnt really discussd or thought about thats why i brought it up...

but anywho - i dont know exactly how i feel about captial punishment....sometimes i think a life sentence is worse on the mind - being forced to live in jail, no choice, no freedom, treated like an animal, no visitors, no real life

Exactly, but it starts with the parent. I've seen parents move mountains so to speak for their kids to get the help they need. Yes, its true the some schools, counselors ect. do not want to get involoved however if the parent is demanding the help, trust me they'll move.

Re: We haven't had a controversial discussion in a while...

I am all for letting the families of the victim decide what the punishment should be.

I am against capital punishment, but not for the reasons most people are. I am going to actully be working with criminal defense this summer (law school internship) so I have some background on this issue.
However I think when a person has been proven beyond a resonable doubt to be guilty, then let the families of the victim choose their fate.

I think killing them is the easy way out. In my opinion let them rot in jail for the rest of their lives (solitary if possible) so that they cannot enjoy their 'lives.'

Sorry if this offends anyone....

no i don't mind at all...we are all allowed to have our opinions and i like hearing others especially if they disagree it gives me more knowledge on the topic.

I'll say it again...

HOW DARE YOU!!!! just kidding.

You are right though it is sad to see how our justice system lets down our children. I mean yuo can't just blame the parents, there are others who see what is going on in the child- the teachers, friends, other students, counselors etc. But unfortunately it is blind sighted at times- like in the instance of the kids who started Colombine. It is sad but true and i think schools should have sessions with teh whole student body to discuss things like this

I agree... the point I am trying to make is that often times (not every time) parents don't realize there is a problem until the damage is done... I know that if I noticed mysterious behavior or that my child was a 'loner' or not acting as a 'normal' child/teenager, I would get to the bottom of it. But sometimes parents chalk things up to 'he's just being a teenager, she's just going through changes... it's all 'normal''

It would be fabulous if we all could pin point that pivotal moment where people decide to be a 'good guy' or a 'bad guy'... some will even argue that mentally disturbed people are 'born that way'.
