Anyone else see the report about pharmacists not filling perscriptions for birth control pills?

Original post by heidla

It was on the Nightly news last night. Some pharmacists refusing to fill perscriptions for the pill and the morning after pill because of their religious beliefs. Just curious what you all think.

I understand having convictions, but IMO you should do your job. If it bothers you that much then I think you should find a new line of work.

Actually no they can not be fired for that , just like a catholic who requires good friday or a jewish person who requires their holiday off does that not mean they can't perform their job no it means that is their belief and we as other religions should respect it.

I know plenty of Catholics and Christians that do not 'require' Good Friday off. If we really must get technical here... the pharmacy can make sure that there are two pharamacists on shift at the same time to make sure that this does not occur.

If I can't work on a certain day or holiday because of my religious beliefs, that does not affect customers or clients. If I, because of my religious beliefs, choose not to fill a certain prescription for someone, that is affecting that person and your religious beliefs should not stop them from doing business at a pharmacy. Someone made a post about being on Birth Control Pills for a different reason than birth control - which happens that many women have to be on the pill for that purpose. So now it's the pharmacist's right and business about why I am taking a certain medication and they will decide if they will give it to me??????
I don't know the original story but I hope that person got fired quicker than they can spell 'Unemployment!!!'

Perhaps if more people had something to believe in and stick to, there'd be less problems in the world

perhaps if more people learned to think for themselves instead of blindly following a religion the world would have less problems.

i think it's absolutely wrong for a pharmacist to do this. sorry but you don't have a right to tell me what medications i can and can not take based on your religion. your job is to provide me with the medication. and going to another pharmacy is not always an option in some parts of the country. not everywhere is like manhattan with a duane read every 10 feet. did we ever settle the question of whether this was private pharmacies or a chain? it must be private right?

Wanna bet? Labor laws are weak in general. If a company wants to fire an employee... they can usually find a way to do so. Even if they don't explicitly say 'your fired cause you wouldn't fill the pill perscription'. They will find another reason.

Which is a cause for them to be sued.. I am a professional liabilty claims adjuster this crap comes across my desk every single day. They can not fire them and if their is a suspicion of foul play they can and will be sued for wrongful termination.

To be honest I am not sure. I don't think that the report stated that information. I would assume that it is private.

Having worked for labor attorneys, it is very difficult to prove that religion was the direct cause for termination.

No but I am the only one in my office that does my job and I am out because of my holiday who does my work no one. can I be fired no.

That is true but It is hard to diprove as well.

well, they can't outright say 'you're fired because your religious conviction prevents you from filling this prescription.'

So, maybe the boss will never address that issue. But, the next time that employee arrives to work late, perhaps the boss will decide that s/he does not tolerate lateness and the employee will be terminated.

I have seen employees be terminated for no reason at all. The employer has the right to conduct those terminations because NY is an employment at will state.

edited to add: the employer does have the obligation to prove that s/he did NOT discriminate based on a protected class (and religion is a protected class)

Most companies now make you sign an 'at will employment' statement. This is particularly tricky to get around when suing for wrongful termination. Can it be done? Sure.

Who are you to say? Just curious this is a pretty powerful remark, just wanted to know who you were to make it.

True. But, the employment at will doctrine is basically protecting the employer from making any kind of contract for employment.

With regard to terminations, the employer still has to prove that s/he did not discriminate based on a protected class.

yes understood, and as you stated earlier the employer can just simply wait it out for other mistakes to manifest in the employee's bahavior/performance before commencing termination.

i was responding to bmd'speanut who stated that if more people had something to believe in (and i'm assuming she meant religion) the world would have less problems. i'm just saying that it can be thought about both ways.

Well, she is a woman after my own heart. I agree with her 100%. I also agree that in this country she has the right to voice her opinion. Just like the rest of us.

So now someone's religious beliefs become mine?? If I am going to the pharmacy to pick up BC Pills, my beliefs do not stop me from doing that. So why should the pharmacist's beliefs prevent me from getting my medication?? It's not MY beliefs!!

I didn't necessarily/specifically mean religion...
