I totally agree. Just one thing though about the private school kids. There are some kids who have scholarships and grants because their parents can't afford for them to go to to the school. So I really do think that kids should be able to get free metrocards but for parents who'e salaries are under a certain amount. The dropout rate and the truancy is outrangous. My FBIL in a cop and does truancy and he won't even talk about what he sees. Why make it easy for kids to not go to school. I HATE Paterson! And if Bloomberg would just give New York some of his money we'd all be better off!

agreed! the people reelected you now share the damnn wealth!

unfortunately, from a purely LEGAL perspective, i think the judge made the right decision based on what was presented and what the law says. However, what the law says isn't always what makes practical sense. If it did, I wouldn't have so many cases on my shelves!

how tho? it's a paper test and they are not asked for their race, religion, ethnicity, etc. until AFTER the test so those who passed the test would have already been in, giving no room to pass judgement based on color. how can he say that the city needs to pay them money they would have gotten if they were given a job however many months ago? that's like telling me, you interviewed for this job a year ago but didn't get it .... here's the money you would have earned. doesn't make sense

I know it doesn't make sense - I agree with that. It's the stupid constitutional analysis that ensues when the court is presented with a certain set of facts. For example, say they charged $500 to take the test. If the plaintiffs can show that minorities are more impacted by this (meaning that minorities are more likely than caucasians to not be able to afford to pay the fee to take the test), there can be an 'inference' of discriminatory intent on the part of the city.

I don't like the idea of being singled out because I'm black, personally. In that instance, I wouldn't want special treatment when I walk in the door! If I want to take the test, I will get the money for it. Don't take me because I'm black and assume I'm poor. And, I certainly don't want my colleagues pissed at me, which they would be, due to what I hate to call pity pay (the retro). I didn't have the job before and you can't assume I would've been working after so what are you paying me anyways? Assumptions should not be made based on any person's color/race. I say revamp the test if it outdated and simply needs to be updated, but please don't single us out..it creates an awkwardness that's so unnecessary. (sorry, I vented)

not to mention the fact that, using the example i gave, it doesn't matter what your race is - if you can't afford it, you can't afford it! if you want to do it, you'll find a way!

that's so stupid

it is. i'm looking up the actual decision now so I can read it in full. because now i'm curious as to what they had that convinced the judge.

holy crap it's a 60 page decision. definitely can't read this now!

60 pages???

btw i just looked and it only costs $55 to complete all the exams (written, physical, medical, and psychological), and $75 to be fingerprinted so $125 total (and this is over a period of time, not all at once) and this is what they have to do:

The Written Exam focuses on a number of topics that gauge a candidate’s ability to learn and perform the duties of a Firefighter, including reading comprehension, problem solving, spatial recognition and applying rules to general concepts. It does not require any pre-existing knowledge about firefighting or the Fire Department.

The FDNY also provides free tutorials to help you prepare for the Written Exam, for information call (718) 999-FDNY.

You will then be called to take the physical portion of the exam. It is a series of challenges designed to test ability in four categories of fitness that are crucial in firefighting.

Based on your performance on these two exams, your name will be put on a civil service list.
You will be called based on your list number and need for Firefighters, which can take approximately two to four years.

Once your number is called, you will take a medical and psychological test, as well as receive a background investigation.

My FH is FDNY and this makes him oh so very mad.........I was with him when he went through probie school and the tests are based on FIRE and thats it. Its not all written either, there are drills etc they must pass.....

as for the poor thing...my FH makes over $100k but I don't think that's what was meant by poor...i apologize in advance for not reading the entire post; work is busy!

my fh is FDNY too which is why this makes me sooooo mad!! i was with mine when he took the tests too and they have NOTHING to do with your race! i'm sorry but if you can't look at a picture and know which way the wind is blowing by the way a flag or fire is blowing, or if you answer a question like 'would your friends or family members consider you an alcoholic' with 'yes' ... you're a dumbasss!

SO you def get it! My FH is cuban and italian and I swear he turns purple talking about it. He can't get why they are going to get retro pay too!!! What? that's such a joke!!!! You know how 'clicky' Firemen are; they are not going to be liked in the houses...I can assure you!

ITA 110%...I was with him throughout the whole entire process. He worked his butt off!!! And it's not that I'm worried he will lose his job since he's been on long enough to hopefully not be fired, but I worry about the individuals that are hired that are working along side him, who run into burning buildings with him, and who he is supposed to depend on to save his life just in case!!! They say the test is biased and unfair so you make the test easier!?!?!?! What else is that going to do but allow individuals who are less qualified, or not qualified at all, to become fireman. It used to be really difficult to get into the FDNY, now they lowered the passing scores for the written, physical, and you don't need ANY college credits. As my FH says, Bloomberg, Patterson they dont give a sh*t, they're not the ones who worry whether their husband, father, brother will come home from work.. And I know I may seem overdramatic but I know that my FD, PD, and military girls know how I feel.

Not overdramatic at all, I worry for no reason sometimes..having a less then qualified fireman w/ my FH in a burning building will not sit well with me.....

i agree, you're not being overdramatic at all. we all worry about our fhs and having people who aren't qualified will only make it harder! not only are the questions on the test easy enough for ANYONE with half a brain to answer correctly, they only need a 70% to pass anyway. if you can't do that, you shouldn't be saving people. most of the people who will complain that they are being cheated out of a job are only complaining bc they think being a fireman means sitting in a firehouse and hanging out all day long!
