Utah Woman Charged With Murdering Fetus

SALT LAKE CITY (AP)--As Melissa Ann Rowland's unborn twins got closer to birth, doctors repeatedly told her they would likely die if she did not have a Caesarean section. She refused, and one later was stillborn.

Authorities charged 28-year-old Rowland with murder on Thursday, saying she exhibited ``depraved indifference to human life,'' according to court documents. Prosecutors said Rowland didn't want to be scarred, and one nurse told police that Rowland said she would rather ``lose one of the babies than be cut like that.''

The case could affect abortion rights and open the door to the prosecution of mothers who smoke or don't follow their obstetrician's diet, said Marguerite Driessen, a law professor at Brigham Young University.

``It's very troubling to have somebody come in and say we're going to charge this mother for murder because we don't like the choices she made,'' she said.

Court documents did not list an address for Rowland, and she is not listed in telephone books for the Salt Lake City area. It could not immediately be determined whether she had an attorney.

Rowland was warned numerous times between Christmas and Jan. 9 that her unborn twins would likely die if she did not get immediate medical treatment, the documents allege. When she delivered them on Jan. 13, one survived and the other was stillborn.

The woman sought medical advice in December because she hadn't felt the fetuses move, documents said.

Regina Davis, a nurse at LDS Hospital in Salt Lake, told police that during a visit there, Rowland was recommended two hospitals to go to for immediate care. Rowland allegedly said she would rather have both twins die before she went to either of the suggested hospitals.

On Jan. 2, a doctor at LDS Hospital saw Rowland and recommended she immediately undergo a C-section based on the results of an ultrasound and the fetus' slowing heart rates. Rowland left after signing a document stating that she understood that leaving might result in death or brain injury to one or both twins, the doctor told police.

The same day, a nurse at Salt Lake Regional Hospital saw Rowland, who allegedly told her she had left LDS Hospital because the doctor wanted to cut her ``from breast bone to pubic bone,'' a procedure that would ``ruin her life.''

LDS Hospital can't comment on the case because of medical privacy issues and the pending court case, said spokesman Robert Pexton.

The doctor who performed an autopsy found that the fetus died two days before delivery and would have survived if Rowland had undergone a C-section when urged to do so. It was not immediately clear how far along Rowland was in her pregnancy.

She was charged in Salt Lake County with one first-degree felony count of criminal homicide. Rowland was being held on $250,000 bail at the Salt Lake County jail, and was scheduled to appear in court Tuesday.

If convicted, she could be sentenced to between five years and life in prison.

A spokesman for the district attorney, Kent Morgan, said Rowland is married and has other children, but he did not know how many.

``We are unable to find any reason other than the cosmetic motivations by the mother'' for her decision, Morgan said.

Caesarean sections usually involve delivery through a surgical incision in the abdomen and front wall of the uterus. Dr. Christian Morgan, a family practice doctor who regularly performs C-sections at the University of Utah Health Sciences Center, said he had never seen vertical skin incisions performed at LDS Hospital for a first-time C-section.

``Even when you need to get a baby out in minutes, it can still be done in the bikini incision,'' Christian Morgan said.

Oh so like I said after seeing that picture she is worried about a scar on her stomach? Sorry but to kill a baby because you were worried about a scar?

Yeah, but who knows what her reason's for not getting a scar are. And one can't really be blamed for being born unattractive... Or portrayed so by the media.

OMG...I'd like to argue that a woman who would kill her child to avoid getting a scar shouldn't have children at all. She just set the pro-choice movement back quite a bit. This disturbs me so much.

and she's fking ugly. (sorry, not exactly p.c. but I can't help it)

OMG.. That b!tch! how dare she!

edited to say that I agree with the majority of the ladies..

BUT, if I were in that woman's shoes, a 'scar' would not get in the way of my delivering 2, instead of 1 healthy babies..

hmmmm -- this is a tough one-- Personally -- I cant imagine -- letting anything stand in the way of my babies safety-- and being born healthy -- but -- How can they charge her with murder... Then you have to charge every mother who does not take their children to the Dr's for immunazation with murder if their children die of diesease, They were told of risks too -but for whatever reason they chose not to get the shots. I think they are out of line charging her.

PS-- I think she is not right for not wanting the c-section-- but thats just me...

Not knowing her situation and hoping upon hope there is more to this then a scar - I agree 100%.

If I choose to have children and carry them to full term and a fairly routine surgery would save their life, it would be a no brainer, I would have the surgery.

I am in NO WAY defending what that woman did-but maybe she looks horrible because her baby just died. and she was arrested. She probably didnt have time to spruce up.

Here is a sitation a family member went through-she has had numerous miscarriages, and her doc warned her that on her last PG she needed full bedrest. She did not follow his instructions, and had a MC. Her reasons are personal, and I dont feel I can judge her. I personally cannot imagine not doing anything I could to save my child, no matter what, but that is me.

Re: Utah Woman Charged With Murdering Fetus

I read this for the first time this morning...

Having a c-section myself I understand where she is coming from with the scar and it changing her life... it does but not for too long. But, she was GROSSLY misinformed. She thought she would have a cut from her breastbone to her pelvis... they havent done it that way for YEARS.

The fact that she didnt listen to the advice from her doctors makes me feel like she doesnt deserve ANY child because she didnt care about the health and wellbeing of her children... but wait, wasnt she at the doctors??? She had prenatal care of some sort.

I don't really know what to think. I think this woman is selfish for not thinking about the best interest of her children by not having the c-section because it would ruin her life but then again if she was morally/religiously opposed to it who am I to judge.

I understand where the gov't is trying to go with this saying that she should have had the c-section because it was in the best interest of both babies but whos to say the babies would have lived regardless. I also think the gov't should step back and rethink prosocuting this woman... it is her body and its not like she harmed the babies (except by excercising her right to not have the c-section which was only recommended not required, or the fact that she looks like she just hit the crack pipe). This is a very fine line and I really dont know what to think. AS you can see by my post Im all over the place

ETA: If someone told ME that I should have a c-section to insure the health and survival of my babies I would insert the spinal block myself and cut myself open if need be... but thats just me.

Does anyone else think she resembles one of the zombies on Dawn/Day of the Dead???

Too damn funny...

Actually, the situation is quite sad but I still think this case is going to open up a can of worms in the judicial system.

No, just killed it.....

Tough situation, no easy answers.
But the bottom line is, a child died.

How very very sad

Re: Utah Woman Charged With Murdering Fetus

wendypoo what I meant by that was to the best of my knowledge she wasnt drinking, using drugs or doing things to jepoardize the eventual life of the children... Im not saying what she did was right by any means but besides not having the c-section which caused one babies death she was doing everything else right... until I hear otherwise

I agree 100%! No one has the right to force anything on you! Yes, I don't agree about her choice, but it is HER body and no one should tell you what to do with it! We are still in america aren't we?

What about the baby's rights?

As I said, it wouldn't be my choice... but I don't think anyone has the right to tell you what to do with your own body. There wasn't always modern medicine and we are fortunate to have it to save many lives. I still don't think anyone has the right to tell you what you should and shouldn't do with your own body. If there wasn't modern medicine, that baby would not be alive anyway. I do think it's a tragedy that a life was lost, especially so early on, but it was the women's choice to do so.

How can you know baby's rights, if its unable to survive or communicate with you? What if baby doesn't want to live? The fact is that nobody knows what the baby wants or doesn't want, but why should a baby have more rights than mom?

So equal rights doesn't apply to babies?
