thinking about calling the wedding off

Original post by I'mCrushed

Hi Ladies,

I have obviously changed my screenname. In a second, you'll understand why.

My FI and I just moved into a new apartment. In the process of unpacking some things, I found some divorce documents that belong to him. He was married once before...and I was totally aware of that . . . .but the documents are dated FEBRUARY 20, 2003!!!!!! It said something on there about CONSTRUCTIVE ABANDONMENT. I have no idea what this means.

When we 1st starting dating 4 years ago, I asked him in general conversation if he was legally divorced..and he told me yes.

Ladies, I am shaking right now. I'm surprised that I got through typing this. I don't know what to do. I think he has lied to me. His credibility is so shot now. I am sitting here having doubt about our entire relationship. I don't know what to think, say, or do. The wedding invitations are out, We have over 250 guests. . .

BTW, what is constructive abandonment?

Please help me ladies.

PS- I know that he never intended for me to find these documents. I noticed how uncomfortable he became everytime I went into that room. Last night, I saw him stuff something behind the couch. He just went to the store and I discovered what was inside the envelope about 15 mins ago.

Re: thinking about calling the wedding off

Before you take drastic measures like calling off a wedding...talk to him about it and discuss his reasons as to why he would lie to you. I hope everything works out.

You have to talk to him about. I agree with talking no yelling.....Keep an open mind a nd listen to what he says it may make sense in the end...Think about everything long and hard be fore you make a decision..

I am so sorry you are going through this

I am the last person to ask about advise when it comes to doubting your marriage b/c I can't take my own, but like everyone has said to me, you have to be open and honest and keep lines of communication open. Tell him you were cleaning up and found the documents and ask him about them, that is the only way you will know the truth for sure. Good luck and I hope everything works out for you.

I agree with everyone else you need to talk to him and listen to what he has to say before you make your decision.

Re: thinking about calling the wedding off

This is what I found about it
Another form of abandonment is called constructive abandonment. Constructive abandonment occurs when your spouse refuses to engage in sexual relations with you for a period of one year or more. The refusal to engage in sexual relations must be intentional and unjustified. Constructive abandonment must continue for a full year despite your repeated requests for the resumption of marital relations.

A failure to engage in sexual relations on one or two occasions will not give you the right to a Divorce. Likewise, if you and your spouse have had sexual relations on any occasion during the one-year period, you will not be entitled to a Divorce on the grounds of constructive abandonment. If your spouse claims a valid medical reason for not engaging in sexual relations, your spouse’s refusal may be justified. Likewise, if the sexual relations that are insisted upon are objectionable or offensive, your spouse might also be justified in refusing your advances. Under either of those circumstances, you would not be entitled to a Divorce.

To be successful in obtaining a Divorce on the grounds of abandonment, you must have objected to your spouse’s conduct in leaving the residence, locking you out, or refusing sexual relations. If you and your spouse voluntarily separate or voluntarily reside in separate bedrooms, a Court might decide that no abandonment has occurred.

Try to talk it out with him - it might just be more mumbo jumbo from the laywers and he didn't want to upset you with it???

I think you should just talk to him. Sometimes men are just not smart enough to put everything out there.

I know when my parents got a divorce it took a long time to finalize and then a whole another set of years for them to divide property.

I think you should just talk to him. He may just have been scared you would of left if you knew of the long drawn out process ahead.

Now my only question is when is your wedding. I mean I am just wondering if your wedding is like next month and he just got the divorce finalized?

Other than that I think it may just really be no big deal and he has a good explanation.

Is it possible that it just took awhile for his ex to sign the papers? I mean, he may have been ready years ago, but sometimes people can be wierd. Maybe she refused to sign the papers (like in 'sweet home alabama').

You definately need to talk this out calmly. I would be really hurt also if I found out my spouse-to-be had lied about something as important as his divorce date. You both may need to go to counseling to work through this. I'm sure once he finds out that you know a huge weight will be lifted off his shoulders. You both love each other and with time you can work it out! Good luck to you!

I am so sorry that you are hurting so bad. Iagree with the other girls, sit him down and hear him out. There may be some sort of explanation for all of this. Don't jump to any major decisions.
Good luck

UPDATE:

He walked in and saw that I was visably upset. He became a little defensive saying, 'what did I do now!' I told him that we had to talk but I needed to take a walk.

I just got home a few minutes ago...He is watching TV in the living room. I'm a little nervous...but just like you all have said, I will talk to him first before drawing any further conclusions.

Again, you ladies are beyond great. I really can't explain how much you are mean to me. Right now you are all the only circle of strength that I have. I cannot thank you enough.

I will update you momentarily.
