Working on Paper 4 school - thought others' opinions might help.
I am writing a paper on post mortem conception and its effects on intesticy laws. PMC is when a man donates sperm to a sperm bank and after his death DW or GF uses the sperm to get pregnant. In some states this is against the law (these states feel that it is "against public policy" to have a child born w/o a father . . .) This is an important issue because a lot of men donate sperm before they go to war for fear that while they are fighting for our country they will become infertile from nuclear weapons, etc. However, some of these soldiers die and many of these solders do not have a will. What should happen to their sperm

I dont know too much about this but it's an very interesting topic. Other cases are when a man had cancer, especially lymphoma(sp?) his sperm cells die off quickly and many men, especially those who get cancer in their tenns or early twenties have their sperm stored, and if they marry and thus pass away the sperm becomes the property of the wife to do as she wishes, and I would guess that in at least a few cases that resulted in a child. I did nto know that it was illegal anywhere, and I think thats sad. It's to me the same as saying a man cant go off to war if he has a child cause he could die...silly thinking almost. I would not be supportive of such a thing.

This is a possible true life scenerio for us. Luckily we got pregnant before we had to try it... Before the military messed up his soldiers.
Unless the sperm was left in a will I don't believe the DW or GF should be able to use it.
The reason it is in a bank is to protect it from the enviornment the father is in, not for in case he doesn't return.
Also the fears aren't just about nuclear weapons at all, it is more about vaccines, radars in planes and machinery and possible chemical weapons that could be used aganist them.
Also where is the statistic about most of them not having a will from? Most soliders in todays' military have a pre deployment briefing where they are told to make their will and also base legal is always open to make wills. My husband and I have had ours since we were 23 and update them once a year.

DoD survey I read said although most soldiers recieve info and instructions for making a will, many do not. Psychologists blame it on a feeling of "invincibility" that many young men experience b4 going to war. I will look for the law review that I got the link to the survey in if you are interested.
