I need legal advice, any lawyers out there???

I have some questions regarding child support. I know that I am entilted to 17% of kayla's fathers salary. Now my questions are is that 17% before or after taxs.

Another question is regarding day care. I heard a few different things one being that he has to split it with me 50/50 then I heard that they go by salaries. I make not even 1/4 of what he makes will they take that into consideration or not?

My ex fi's mother is now butting in and telling me that he gives me too much money and now he doesn't want to pay it, so I am trying to figure out if what he gives me is fair.

If anyone has any legal expertise in this area that would be great. Thanks so much for everyones help with this whole sticky situation with that a55hole I almost married.

Meridith: See a lawyer. If you cant afford a lawyer, seek legal aid (its a program run by the city for anyone who can not afford a lawyer. Contact phone numbers should be on a NYC website or something. Maybe do a google search)

Hopefully any of the lawyers on here can get you in contact with legal aid.

If you take him to court for child support you can make him liable for court fees.

You just need to get down to family court ASAP and file for child support.

The court will then tell him how much he has to pay. If he doesnt, they can have his check garnished to give to you.

You should go see a lawyer; this is something that you want done properly and word of mouth is not always accurate. Look in the phone book and make some calls; I believe some attorneys offer free consultations.

Meredith, here is a link for the NY state Child Support Enforcement. You are entitled to 17& of his gross income for Kayla.

try calling 311 and see if the city resource center has some suggestions for free legal advice.

I forget how the child support worked, as far as if the 17% is before or after taxes, but I know my ex has to pay about 65% of the daycare because he makes that much more than I do. If Kaylas dad makes alot more than you do, he'll definately be entitled to pay more than 50%.

i work with disabled individuals, and when they need legal representation we call Nassau-Suffolk Law Services. They are non-profit. check them out www.nslawservices.org. they have a child support program Good luck!

I can't give legal advice but I will advise you to definitely get a lawyer. I know a few women who have balked at it but let me tell you, if he tries to mess with the payments or anything else, you lawyer will make sure it is very uncomfortable for him. So it's the initial legal advice but also someone who knows how to make sure he is paying what he should - and paying it in a timely fashion. If he has any self-respect or cares what other people thing of him, he won't want his wages garnished for child support.

Alot of time women don't want to have to have to fight - I can see how stressful that can be, plus with his mother interfering, you need someone who is going to look out for your (&Kayla's) best interests. You are probably entitled to alot more than you know. My brother is divorced and as far as child support goes, he pays a percent of his salary, as you discussed plus he has to pay for a % of my nephews afterschool, summer camp, other things too.

Good luck, I wish you much strength! You already have lots of courage ending a very stormy relationship - alot of women dont and stay when they are being mistreated {}

another thing to consider - for a small % (I believe 1 or 1.5%) the courts will handle his payment to you. My GF's ex is a real ba$tard and would miss payments all the time. She got the family courts involved and now they garnish his salary automatically, the $ goes to them and they give her the $$. this way, she is always assured of payments - it's worth the 1% 'fee' to her. there is a legal term for it, but i can't remember. if you want details, i can ask her and let you know.
