relax.... the first step, which i'm glad to see you are doing, is to see a lawyer. she can't use your FH's child as a way to extort money out of you. the lawyer (hopefully one who specializes in domestic relations law) will answer all your questions and find a solution that works for you. i can't give you any specific advice b/c i am a virginia lawyer and don't know diddly-squat about new york family law. best of luck - i'm sure it will all work out.

Oh please don't worry! My DH has 4 children from a previous marriage and that was a big concern of mine! We consulted 2 lawyers before we were married on this issue and were assured that my income has no effect on the amount awarded for child support and maintenance. I also looked online in a number of places and was assured again that my income has no bearing on the calculation. If I find any of my old links I will send them to you!Yes, you can love his child - and should as he will be your stepson. But his financial responsibility is still on the parents.

You are doing the right thing by consulting a lawyer. In my previous marriage, my ex had a daughter and her mother tried to get money from both of us, turned out she was NOT able to touch ANY of my income at all. I would imagine it would be the same in every state, but definitely talk a lawyer.

I am a prelaw student and Like april said your income has no effect what so ever on child support. It is based soley on his income alone.Bridget

You came to the right place!!! I am a pro at this as my FI has two children from a previous marriage and I have one child from my previous marriage.Please don't get upset, that is just what she wants you to do!
I can't make this any clearer than this, YOUR INCOME HAS ABSOLUTELY NO BEARING ON THE AMOUNT OF CHILD SUPPORT YOUR HUSBAND WILL PAY. PERIOD!
I get so angry when ex's try to pull this stuff because basically they are ignorant and just trying to ruin a special time for you. (Can you tell I've been through this
)According to the CSSA guidlines, that is dilegently following by New York State, Child Support is solely based on the biological mother and father's incomes.

Relax,Like the others have said child support is based on DH income, not your's.
Please don't let her nonsense affect your relationship with your stepson.

Ditto as all these women have said.. I know because I am that child!!!My biological mother dumped me like yesterday's trash when she divorced my father. Then she filed harship and told the courts she had no money 'Booohoo' Ended up with $50 each per month for my brother & I. (Hell she didn't even pay that, another story).
Off she goes happy as can be and marries this really nice man. He's rolling in it. His money has no affect on what she owed us on child support. As a matter of fact, that's exactly when she stopped paying.
So.. she's a little over 6 thousand in debt for back child support, but doesn't care. She has a beautiful house on the beach in Denton, Fl. My half sister who's 14 has picked out her convertible, has a cell phone and is very chic. (I actually like her, she's alright).
So.. again. You could be a millionaire. That woman won't see a penny of it.
If you wanted to support your stepson out of your own pocket, I'd suggest actual purchases as opposed to money gifts.
I had this person in my life who paid for part of my college tutition and other debts that come from growing up. This person had no legal obligation to do so, just really was a good person. I think highly of this person for going outside the norm for it.
Sure wish that person were still on speaking terms with another person in my life.. I could use some help with this wedding!! LOL
