The topsy-turvy relationship of Charlie Sheen and Denise Richards appears to be back off, as her rep tells PEOPLE: 'Denise is moving forward with divorce proceedings.'

On Wednesday, lawyers for both Sheen and Richards asked that the case be removed from Los Angeles County Superior Court and handed over to a private arbiter, retired commissioner Jill Robbins.

A source close to the couple tells PEOPLE: 'I don't think this relationship (between Richards and Sheen) is going to work.'

Sheen's rep, Stan Rosenfield, had no comment.

Until Wednesday's filing, the pair – who split last spring while Richards was seven months pregnant – seemed to be patching things up. After their daughter Lola was born last June 1 (older sister Sam turns 2 in March), Sheen and Richards had been spending more time together, including a 65th-birthday party for Sheen's father Martin on Aug. 7, where they shared a loving smooch.

Sheen, 40, admitted publicly that he and Richards, 34, were working on a reconciliation. 'Things are a whole lot better, and I think with that (comes) hope,' he told TV's Extra in an interview broadcast Aug. 22. 'We're not ruling anything out.'

The actress, who cited irreconcilable differences in her March divorce petition, was also sporting a new diamond on her left ring finger last summer. While it looked strikingly like the 4.3-carat engagement ring Sheen gave her in December 2001, it was actually 'a recent gift from Charlie,' a source close to the couple said, 'showing her how much he wants things to work out.'

Sources also claimed that Richards was equally open to a reunion. 'She never wanted to get divorced,' said one. 'She always hoped they could save their marriage.'

As matters progressed – or, now it seems, regressed – the two maintained separate residences: he at their Agoura Hills, Calif., home and she at a new house a few miles away.

The buzz is that the engagement of the happy couple has hit a few bumps and, after reportedly tense holidays spent at Holmes’ house, wedding plans may have been put on hold.

With a new year beginning, Cruise “decided to take the opportunity to mend fences with the family of his fiancée, Katie Holmes,” according to the upcoming issue of Life & Style Weekly. It didn’t go so well.

“Tom and Katie ended up leaving — three days earlier than planned,” according to a “close friend” of Cruise. “Katie was in tears, but that’s standard when it comes to dealing with family matters and Tom.”

A spokesman for Cruise denies the story, but there have been previous reports that Holmes’ lawyer father is not thrilled with the prospects of the two getting hitched.

“My honest opinion is that the wedding’s not going to happen,” a “friend of the couple” told the mag. “Neither one of them seems as enthusiastic as they once did about marriage.”

Not for anything, but she's starting to look ethiopian-like. It's just absolutely sad that people will do this to their bodies. Sure, you get skinny, but have they NO CLUE as to what it does to their insides? Their reproductive system? Do they HONESTLY think they look GOOD? Come on, I'll take looking like a REAL woman ANY day over that of a 10 year old boy! She's the same shape and size as my nephew!!

Sad, sooo sad.

Sweetheart, get yourself some help, FAST.

I don't know ONE trainer or nutritionist that could agree with her on that one. Other than the one's on her retainer.
