Jewler sent us a bad check

Ok, so we dealt with an independent jeweller in another state (kind of a family friend), and he created my e-ring for us.

When we first got it, we noticed it was not the same setting that we previously ordered, so we contacted him, he told us to send it back and we did. We get a call from him stating that he can't get the setting in that we want......that's fine, so I picked another setting out and it came out to be even cheaper. So he was to send us the difference in the mail.

We received the ring finally, and it's beautiful. In the package was the refund (check). We put it in our bank and found out it was bad. Our bank charged us $10.00 because his check bounced (makes no sense to me). So we contacted him and told him what happened. He tried to explain what happened on his end.......and then said he would pay the bank charge and re-send another check to us. He asked if that would be OK. I said 'as long as it doesn't bounce again'

So that was 3 weeks ago. Nothing in the mail. I've phoned him but he won't return my calls.

Don't know what to do...........

Any advice???

Get over it and don't use him anymore.....

Wait a second, I change my answer. I'm sorry, I thought it was just about the 10 bucks, not the whole check.....have whoever is the friend call him.

Leave him a message that you are going to report it to the Better Business Bureau if he doesn't get back to you in 3 days. Then if he doesn't, file a complaint.

Sorry you're in this situation

You can file a complaint, sue him, have an attorney send him a stern letter stating that you will file a complaint and sue him, send him a letter yourself stating the above, or drop it. I wouldn't get the friend who referred you to him involved. That could be more trouble than it's worth.

Call, leave a message, tell him you will have to call the BBB.

Then, don't even wait for a return call. Sent a 'demand letter.' Say that you will sue and call the BBB if necessary. If you have a lawyer who can send the letter on their letterhead, then do that.

See if you get a response.

If not, then, SUE!!!!

If it falls within small claims court jurisdiction, it will be easier to do without a lawyer.

I'm a lawyer, but you may get different advice from a different lawyer.

Call him and tell him you are going to call Shame on You and put him on the news! What an awful thing to do to a young couple trying to pay for a wedding! So sorry you're going thru this drama...

DO NOT TAKE ANOTHER CHECK FROM HIM!!

You should continue to call and even send him letters if necessary. (Certified, return reciept) and demand that the payment be sent as a money order or CERTIFIED check only. he's being shady...it's not your problem if he doesn't have the cash. he spent the $$ for your e-ring without being able to have some extra when the price difference was lower for the new one??? bad business dealings!!

don't let him get away with it...tell him you're gonna report him to the BBB!!

That is horrible. I am sooo sorry. I would keep on calling him. Harass him....

Thank you all for your advice. I think I'll take you guys up on reporting him.

I don't understand why he would do this. But I guess he'll soon realize that he can't do this anymore.........bad way to run his business :(
