question about leaving a job + vacation days

if you leave a job (by choice ... not because you're fired or whatnot), is the company required to pay you for any vacation days you've accrued?

I think so. I know that I have days that carried over from last year and I would expect to be paid for those and whatever I've accrued so far this year.

I think it depends on the company.

Mine has a 'use it or lose it' policy - so they never cash out for vacation days, whether you didn't get to take them all or even if you leave under your own terms.

my company does something similar ... but i think it's different if you're quitting, no? (this isn't for me, btw - it's for DH)

My understanding, generally speaking, is that if you walk away from a company you walk away from your vacay days. I don't think they 'cash you out' when you resign. I agree with other posters though - every company is totally different.

any company I have ever left paid me for unused Vacation days. Sick days they wont.

It depends on the company...There is no set law or regulation that states if you leave, you are entitled to your days. He will need to look over his company policies or contact someone in HR to find out.

he should be able to find out from asking around. or from HR. in my old job, i cashed out and got a really great check at the end

i think this job is use it-or lose it

Have him check his policy and procedure manual. It'll be covered in there. It may depend of when he resigns in the calendar year and how long he has been with the company.

I know at my job if you leave they will pay you half of your accrued time.

Agree.

It depends how you earn them. Mine accrue, I don't just get 25 days in the beginning of the year, basically each paycheck I 'earn' a day. So if you 'earn' yours, you would most likely be paid out.
