I just wonder why NY don't enforce the crossing laws.When I lived in California, I got a j walking ticket, and then from then on, i crossed at the corners, and while the walk sign said walk.
I understand this may not apply to all areas on NY but still...

I feel TERRIBLE for this girls family.I must say though, TWICE recently I was driving and got very scared. One time someone was standing in the middle of the road(crossing, it was dark and I didn't see him until I was RIGHT near him. The next time someone was walking on the side of the road (no sidewalk) and again very dark and didn't see him until he was right there. I know first hand if I would have had to swerve out of the way of another car, I could have hit these people. If he purposely swerved b/c the guy was going too slow, that's another story.
Either way, I'm sure this man will live with the guilt everyday for the rest of his life. And her family will live with the pain.

I'm sure the feeling of wanting somebody to be held responsible is normal in this situation but if it is proven to be an accident then thats just what it is.I'm sure unfortunalty lots of ppl die in accidents everyday. Its very sad. Since we are all human and all make mistakes it could of just as easily been anyone else behind the wheel of that car.
I do not think he should be punished for what happened.
Not that this poor girl deserved this but she should not of been standing in the road. Expecially in such bad weather.

If it were my child, of course I would want to see them punished. However, As a person on the outside looking in, I don't think he should be punished. It was an accident. Unfortunately,the girls should not have been standing in the middle of the road. I think this guy will live the rest of his life with the thought of killing a person. The guilt he will feel for the rest of his life will be punishment enough. Unfortunately, the family is greiving and doesn't see it that way. JMO

I think the fact that this motorist killed a young person, is 'punishment' enough. I don't know how he will continue to live his life (as he had prior to the accident) knowing that he killed a child. Very sad - for all who were involved.PS - I really don't see the relevancy behind him not wearing any pants. And the swerving bit seems like heresay - IMO.

I could be very wrong here but, I think the law states that when you are driving a motor vehicle you are to understand that it can be a deadly weapon. This is not the first time at all that someone will be charged with accidentially killing someone in a car accident. They get charged with involuntary manslaughter.Now as for who was to blame, I say let's wait and see what comes out in court, if it get's that far. How slow was the driver going in front of him? If the guy was going 15 mph, I would have passed him too. Was the passing a legal passing, in other words was there a lane there, or did he pass in the shoulder? All of these things have to be examined. Are the girls at fault for standing or crossing in the road? Maybe, but let's not forgot that New York law states that pedestrians have the right of way and drivers should always be aware of them.
I feel badly for those of you that knew someone who was involved in this tragedy. My heart goes out to you. But you have to try to put yourself in the shoes of others also. Think of how you would feel if your FI/DH was the person that hit the girl. What if it were a complete freak accident? How would you like it if people were passing such harsh judgment without knowing all of the facts?
As far as the no pants things goes, I don't understand it. But I also don't think it's against the law to drive without pants.

I respectfully yet strongly disagree with this statement. A 2 ton object is far more likely to kill or maim if it's moving at 70 mph than if it's moving at 20 mph.

I agree with Jenn524. There are so many unknowns it's difficult to comment.
The no pants issue could be relevant to the extent that it makes you wonder if this guy was drunk, high, playing with himself, etc. Like someone else said, when driving you are in control of a potentially deadly weapon and you need to be operating on all cylinders.

When you're talking impact, yes, someone going faster will do more damage than someone going slower. But if someone is going too slow, they are in fact hazardous - there is a minimum speed limit set as well...and it's for a reason.As for whether the driver was under the infulence, it was already stated that he wasn't - no alcohol, no drugs.

At the very most collect no-fault insurance for whatever thats worth
apparently for lots of people money fills some void. However, I don't think this man should be punished for life. Unless it can proved that this is not an accident and premediated or drugs were involved...Otherwise, No way.

I think there is a difference between an accident and complete carelessness and recklessness. Yes it was hearsay but if its true that the driver speed up and swerved around a slower car he should be held responsible. He obviously was going fast enough to throw her in the air and kill her while she was standing IN BETWEEN two friends. At the very least I think they should investigate what happened.

Until this case is investigated, all of this is hearsay, IMO.

This is truly an accident. It's awful and sad, but I am sure that he is suffering enough with the knowledge that he killed someone. There is nothing to lock him up for, nor anything to sue him for (although I am sure that will happen...it's NY). I feel badly for everyone involved.Edited to add: I only read and commented on the original post. However I have to say that it's up to the police to investigate and determine if there is any fault on the drivers' part. Until then the man is innocent until proven guilty.

I didn't read through everyone's response, but the few I read I agree with...It was a terrible accident and the girl should not have been crossing or standing in the middle of the roadway at night. The guy did nothing wrong. I'm sorry for all those who were affected by this (either knew them perosnally or such), but I do not see any reason to punish the guy. No amount of money will bring their daughter back!

Im not going to get involved. Except to say Lets all teach our children to cross at lights and with the walk and dont walk signs. I live down the block from a middle school and High School middle school has a crossing gard and the high school has a light 90% of the kids dont cross there because its not 'COOL'

i feel very bad for the girls family, but it was just an accident, they should not have been standing in the middle of the road, in the dark in the pouring rain.he's going to have to live the rest of his life knowing that he killed a child which i think is punishment enough.

I have to agree with Jenn...Its negligent/involuntary manslaughter...when operating a car in the rain, all speed limits go out the window (I was given a ticket (for excessive speedin hazardous condidtions...so crap like that) for causing an accident (just fender bender) on southern state/blet pkwy - and I was only going 40 mph in the rain)
usually if I remember correctly and maybe the lawyers can verify...its 4 years prison/probation/parole...whatever combination
it all comes down to the lawyers and the jury at this trial...thats why voir dire is probably the most important aspect of a trial...the defense wants to make sure they don't get people that have already convicted him...
as for the congressman...no offense...but I think his comments were uncalled for...he has convicted the guy w/o a trial...and only b/c this is an election year...
