Yes accidents do happen but in this case, I am not so sure. According to what Noel (04bride) said, the girls were doing nothing wrong. They were not standing in the middle of the street. I have had many problems lately with people tail gating me while driving and then speeding up to an excessive speed to get around me and I in no way consider myself an abnormally slow driver. Every time I look in my rear view mirror..someone is on my butt or trying to go faster than necessary..its ridiculous.I do agree that many kids nowadays cross the street recklessly thinking that nothing can happen to them. I go through this with my 16 year old brother all the time and it drives me crazy..they have this syndrome thinking that nothing bad can happen to them. If what 04bride says is true, which i think it is, then I do think the driver is responsible.
Look at the case a couple of weeks ago..a pedestrian was crossing the street but apparently was moving too slow for a driver who was coming down the block. Ok..now the guy was obviously crossing against the light BUT first off..who of us hasnt done that in our lives and secondly did it give this man the right to jump out of the car and beat the pedestrian to death?!?!
All cases and situations are different but I know if it were my child, I would want some sort of punishment. I cant even imagine what this family is going through.

CP-I said it was hearsay and I said it should be further investigated. Not that it matters but I know someone who is close to the family.

I say accidents do happen. I live in queens and as a non-reckless driver, Do you know how many times I almost hit a child because they either ran in the middle of the street or didnt even look when the crossed. Its a terrible thing that happened
I wasn't paying attention on Queens Blvd (thank goodness DH was) and I stepped out right in front of Cherokee...DH pulled me back in the nick of time...
although that is the Blvd of Death...

I think it depends on what the laws in NY are. I know that in MD, you can cross over the double yellow line to pass another vehicle if it is safe to do so. Not sure if NY is the same.Also, I agree with Jennbaby that crossing laws should be enforced. I sat through a trial a few months ago and listened to a mother go on and on about how she and her young son were hurt so badly by a car, when they decided to cross the street in the rain, in the dark, during rush hour, about twenty feet away from the intersection. Not sure what she expected to happen when she decided to risk her life and the life of her son because she didn't feel like walking to the intersection and waiting to cross.
People need to understand that as pedestrians there are laws to follow as well. While it is always a tragedy when someone dies as the result of a motor vehicle accident, that doesn't necessarily mean that the driver should be in jail for the rest of his life.
I don't know what these girls were doing, but IF they crossed the street when there was a car coming (and it sounds like there was a car coming towards them, although perhaps a bit slower), and they weren't at a corner and it was raining, the accident might not be totally the fault of the driver.

I know in Germany crossing laws are enforced...imagine getting a $10 ticket for crossing at a 'Don't Walk' sign? (well that was the price in 1992...i'm sure they have gone up)I couldn't believe that people watied for the light to turn green even when there was not a car in sight!!!
even my friend there says, she will not cross if there is a child anywhere near...she says it sets a bad example...
why are we always in such a rush?
