EDIT- post dated check

I spoke with the vendor, he apologized.

for those of you who didn't read the OP... I put out a warning about post dating a check..
long story short, I post dated a check, it was deposited two days early.. I got hit with bank fees.. called the bank, they said it was illegal to post date a check.

I looked it up and it is NOT illegal to post date a check, it is however ILLEGAL to post date a check knowing you do not have enough money to cover the check at the time it is written... how that makes sense I don't know, because if you have the money then why bother post dating??

so we'll leave it at that.

ladies- if you are offered a chance to post date a check because you know you do not have the funds at that time... don't do it! simply offer to give them a check a later time.
Trust me, its not worth the headache!

its not illegal to post date a check, it might be against the banks policy to accept post dated checks, in which case they still have to honor it as of the date deposited, or they cna choose to not honor it at all, but its most certainly not illegal

I don't know, when I called the bank this morning she said it is ILLEGAL (repeated that word several times) to write a post-dated check.. I didn't think it was true... and I'm looking it up now.

according to what I found online, it is not illegal to post date a check, it is illegal to write a post dated check KNOWING you do not have money in your account to cover the check.

I told said vendor that I had to transfer the funds.. which we did the last time we were there as well.

I just wanted to warn other brides of this.

yeah i think that's right actually. that wasn't cool of your vendor for depositing the check.

I'm so sorry this happened to you. WHen I closed on my co-op, my lawyer explained to me that it is okay to post-date a check, but it is not okay to write that check when you don't have funds in the account on the day that you write it. In other words, even if you post-date, make sure you have enough $$$ in your account to cover that check on the physical day that you write it!

I work at a bank and we won't accept post dated checks as we were told that it is illegal for a bank to take a check like that.

It's not illegal to write one, it's illegal for a bank to accept it.

Banks will lie to keep from refunding fees that are their faults. My mom accidentally wrote a check from my brothers check book thinking it was a check from her joint account with my dad (dad and brother have the same name and address). It was a large check and my brother didnt have the money to cover it, and happened to have a few things bounce on him because of it. He was charged a few hundred in overdraft fees. He called the bank to explain the mistake and ask why they accepted the check when it was clearly not his name signed on it. They said since my mom has the same last name and address they are allowed to accept it. That makes no sense. They told him to file a claim with the fraud dept to get back the fees. Im actually not sure how it ended out. My mom gave him back the money and im sure the fees too if the bank didnt.

I hate to say this but your Mom's bank is horrible. I manage a bank, and let me just say that if the bank had any faults, they should work with you. It is up to the managers discretion to return any UCF/NSF fees. The bank should not in anyway pay a check that is clearly signed by a non-depositor. If your mom calls the corporate headquaters (which trust me, they will but her through to a VP are President) they will have to listen to her and refund her some if not all the fees!! Hope everything works out for your mom and brother and HTH.
