Plead Not Guilty. Most of the time the cops don't even show up to court or they don't remember the case (although you gave him a lot to remember!) they might just throw it out if he doesn't show up.

I would NOT mail the ticket in .. simply appear on the date provided on the ticket .. you can plead not guilty then and there .. with your reasons .. no need for delaying this any further.

And I still feel the need for a lawyer on this may be an additional expense not needed.

I was just in traffic court .. in Hempstead .. not too long ago .. (a different one then where you need to go) .. and they were very generous there .. made offers to everyone! .. even excessive speeding violations got knocked down to 'failure to yeild' violations!!

When people were not happy with the offers given to them .. or if there were complications .. 'trial dates' were set.

If you needed to go to that extent .. you could always get a lawyer then .. but I wouldn't do that just for this ticket .. you're going to dig yourself deeper with additional bills.

Just wanted to add:
In my recent traffic court experience .. and in the past .. cops never show up for anyone .. and NO ticket ever got kicked because of it. Maybe if you're scheduled to go to trial and the cop doesn't show up .. that might be a different story.

We cant afford this.. $105 and we did nothing wrong.... my insurance will go up.. this is a bad time..

There has to be something we can do!

As someone who works for insurance and whos FH is a cop...FIGHT IT!

I just had a run in, Friday actually, w/a state trooper who pulled me over for supposedly speeding and not using me left directional(that is the only thing I was guilty of). I pulled out MY PBA cards( FH- cop, BIL-a cop and FBIL-a cop) and he didnt look at them and proceeded to give me TWO tickets. MY FH is working on this situation but if not, I am appearing in court with a FIGHT! First I wasnt speeding since I was coming off a ramp. He didnt even state how much I was speeding OVER. 2nd he would be the 1st that denied my PBA. Now I know I was guilty of one and I was nice to the PO. No reason for the tickets.

I feel for you and hope this works out for you. Unfortunately there are cops who are having bad days and can take it out on the wrong ones. Do your best, plead not guilty and hopefully it will be a lesser charge plea with no problems through insurance. GOOD LUCK!

FYI - The wrong info thing doesnt mean that the ticket is void.
There is a trick I have used a couple of times and so has DH (although im not sure the law is still the same since I moved). You are allowed to reschedule your court date 2 times. Plead not guilty then reschedule your court date 2x. In order to be found guilty the cop needs to show, many times after all the rescheduling the Cop wont remember who you are and therefore not show. If he is a no show you win.
